RESOLUTION NO. 6 913
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING THE ANNEXATION TO THE
CITY OF CERTAIN UNINHABITED TERRITORY CONTIGUOUS
TO THE CITY OF NEWPORT BEACH AND KNOWN AS .
ANNEXATION NO. 62, UPPER HARBOR VIEW HILLS,
PHASE II
WHEREAS, The Irvine Company, a West Virginia corporation,
as the sole landowner of certain uninhabited territory contiguous
to the City of Newport Beach initiated proceedings with the
Local Agency Formation Commission of Orange County to annex
said unincorporated territory to the City of Newport Beach; and
WHEREAS, on October 28, 1968, the City Council of the
City of Newport Beach adopted Resolution No. 6898 declaring its
favorable consideration of and signifying its preliminary
consent in principle to, the annexation of that certain territory
known as Upper Harbor View Hills, Phase II, to the City of
Newport Beach; and
WHEREAS, said Resolution No. 6898 of the City Council
requested that the Local Agency Formation Commission authorize
the City Council of the City of Newport Beach to proceed with
subsequent annexation proceedings without further public
hearings or notice; and
WHEREAS, on November 6, 1968, the Local Agency
Formation Commission approved the annexation request of the
Irvine Company and further authorized the City of Newport Beach
to proceed with subsequent annexation proceedings without further
notice and public hearings; and
WHEREAS, on September 30, 1968, the Irvine Company,
as the sole owner of all territory known as Upper Harbor View
Hills, Phase II, filed a petition with the City of Newport
• Beach to annex said uninhabited territory,which is hereinafter
more particularly described, to the City of Newport Beach; and
WHEREAS, the Irvine Company as owners of more than
two- thirds of the value of the land in the territory to be
annexed have filed written consent with the City Clerk stating
that said territory may be subjected to taxation after
• annexation equally with other property in the City of Newport
Beach to pay any indebtedness and liabilities of the City
outstanding, contracted, authorized, or existing prior to or
at the time of said annexation; and
WHEREAS, the City Council of the City of Newport Beach
hereby elects to proceed with said annexation proceedings
without further public notice or public hearings in accordance
with the provisions of Section 54797.1 of the California
Government Code; and
WHEREAS, it appears that the necessary proceedings
relating to annexation have been conducted strictly in accordance
with the requirements of the Annexation of Uninhabited Territory
Act of 1939;
follows:
NOW, THEREFORE, the City Council hereby resolves as
1. The annexation to the City of Newport Beach,
California, of that certain uninhabited territory contiguous to
said City, known as Annexation No. 62, Upper Harbor View Hills,
Phase II, is hereby approved. Said property is more particularly
described as follows:
Commencing at the Southerly corner of said Block 92;
thence North 49° 27' 55" West 687.38 feet along the
Southwesterly line of said Block to an angle point in
the existing boundary of the City of Newport Beach as
described in Annexation No. 57 and established by
Resolution No. 6203 and the True Point of Beginning;
thence continuing North 49° 27' 55" West along said
boundary 1934.73 feet to a point on the Easterly line
of MacArthur Boulevard, 100.00 feet wide, said point
• being on a curve concave Northwesterly having a radius
of 2050.00 feet, a radial to said point bears South
48° 54' 12" East, said point also being in the boundary
of said City of Newport Beach as established by Ordinance
No. 999; thence Northerly 390.28 feet along said curve
and said boundary through an angle of 10° 54' 28 "; thence
continuing along said boundary and said right of way line
North 30° 11' 20" East 1095.50 feet to the beginning of
a curve therein concave Southwesterly having a radius of

2050.00 feet; thence Northwesterly 283.36 feet along said
curve and said boundary through an angle of 7° 55' 11" to
an angle point in the boundary of said City of Newport
Beach as described in Annexation No. 61 and established by
Resolution No. 6704; thence along said boundarT the
following courses and distances: South 600 26 00" East,
523.98 feet; North 55° 02' 00" East 410.00 feet; South
44° 03' 00" East 1200.00 feet; South 69° 34' 00" East
575.00 feet to a point on a curve concave Northwesterly
having a radius of 4000.00 feet, a radial to said point
bears South 550 57' 27" East; thence leaving said boundary
Southwesterly 788.95 feet along said curve through an angle
of 110 18' 03 "; thence non - tangent South 44° 39' 24"
East 50.00 feet to the Northwesterly line of the land
described in the deed to Pacific View Memorial Park recorded
January 10, 1962, in Book 5970, page 522 of Official Records;
thence South 45° 20' 36" West 908.02 feet along said
Northwesterly line to the Northerly corner of the certain
reservoir site described in a deed to said City of Newport
Beach, recorded December 20, 1957, in Book 4143, page 395
of said Official.Records, and an angle point in the existing
boundary of the Big Canyon Reservoir Annexation to said
City of Newport Beach, as said boundary was adopted by a
Resolution of the Board of Supervisors of said Orange
County, dated December 17, 1958; thence South 45° 20' 36"
West 76.12 feet along said boundary to an angle point
therein; thence South 50° 26' 36" West 557.89 feet
continuing along said boundary to the True Point of
Beginning.
2. The property in the aforesaid Annexation No. 62,
Upper Harbor View Hills, Phase II, shall be subjected to taxation
after annexation equally with property within the City of Newport
Beach to pay any indebtedness and liabilities of the City of
Newport Beach outstanding, contracted, authorized, or existing
prior to or at the time of annexation.
3. The boundaries of the City of Newport Beach,
California, be, and the same are hereby altered to include the
territory described herein, the annexation of which is approved
herein, and incorporated in the City of Newport Beach, California.
4. The City Clerk is hereby directed to file a
certified copy of this resolution with the Secretary of State.
