• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DETERMINING THAT FURTHER PRO-
CEEDINGS FOR THE PROPOSED CONSTRUCTION OF WORK AND
IMPROVEMENTS IN ASSESSMENT DISTRICT N0. 52 BE
CONDUCTED WITHOUT FULL COMPLIANCE WITH THE
PROVISIONS OF THE "SPECIAL ASSESSMENT INVESTI-
GATION, LIMITATION AND MAJORITY PROTEST ACT OF
1931 ".. DIRECTING THE PUBLIC WORKS DIRECTOR TO
PREPARE PLANS AND SPECIFICATIONS FOR THE WORK
WHEREAS, on March 10, 1969, the City Council of the
City of Newport Beach adopted Resolution No. 6942 declaring its
intention to hold a public hearing for the purpose of determining
whether the provisions of the "Special Assessment Investigation,
Limitation and Majority Protest Act of 1931" should or should
not apply to the proceedings for the construction of certain
street improvements in Assessment District No. 52 pursuant to
the Improvement Act of 1911, and setting a hearing before it for
the 28th day of April, 1969, at the hour of 7:30 p.m. to consider
protests; and
WHEREAS, the City Council has held said hearing in
accordance with Resolution No. 6942 and has considered all
protest's and objections, both written and oral, to the waiver of
said "Special Assessment Investigation, Limitation and Majority
Protest Act of 1931 ";
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES HEREBY RESOLVE, DETERMINE AND ORDER, as follows:
Section 1. The public convenience and necessity require
that the proposed work and improvements in Assessment District
No. 52 be constructed without full compliance with the provisions
of the "Special Assessment Investigation, Limitation and Majority
Protest Act of 1931 ", Division 4 of the California Streets and
Highways Code, and in lieu of such full compliance the City
Council elects to follow the provisions for waiver thereof as

set forth in Section 17 of Article XIII of the State Constitution.
Section 2. The Public works Director is hereby
directed to prepare plans and specifications for the work proposed
• to be accomplished pursuant to Assessment District No. 52.
ADOPTED this 28th day of April, 1969.
