A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH REQUESTING THE ORANGE COUNTY LOCAL
AGENCY FORMATION COMMISSION TO APPROVE THE
ANNEXATION OF UNINHABITED TERRITORY KNOWN AS
ANNEXATION NO. 66, SANTA ANA RIVER -COAST HIGHWAY,
• WITHOUT NOTICE AND HEARING
WHEREAS, there is situated outside of and contiguous to
the City of Newport Beach, certain uninhabited territory within
the meaning of the Annexation of Uninhabited Territory Act of
1939, said territory being hereinafter more particularly
described; and
WHEREAS, annexation to the City would make municipal
services available to the property owners and be for the best
interests of said owners and the City of Newport Beach and its
residents; and
WHEREAS, an application for annexation of the parcel
of land to the City of Newport Beach is being submitted by the
City of Newport Beach to the County of Orange Local Agency
Formation Commission; and
WHEREAS, written consent to said annexation has been
submitted by all the property owners located within the territory;
and
WHEREAS, the area proposed to be annexed contains
approximately 2.65 acres of uninhabited territory located at
the western boundary of the existing city limits, bounded on the
north by Pacific Coast Highway and on the west by the Santa Ana
River and on the south by the Pacific Ocean, which area shall
be designated as Annexation No. 66, Santa Ana River -Coast
Highway; and
WHEREAS, Section 54797.1 of the California Government
Code provides that where an application for annexation to a
City is signed by all the property owners within the territory
or written consent has been filed by all of the property owners,
the Local Agency Formation Commission may approve the annexation
without notice and hearing and may further authorize the
legislative body of the City to annex such territory without
notice and hearing by the legislative body and without an
election;
• NOW, THEREFORE, BE IT RESOLVED that the City Council
hereby requests the Orange County Local Agency Formation
Commission to approve the annexation of uninhabited territory
known as Annexation No. 66, Santa Ana River -Coast Highway, to
the City of Newport Beach.
BE IT FURTHER RESOLVED that the City Council requests
the Local Agency Formation Commission to approve such annexation
without notice and hearing and to approve and authorize the
City of Newport Beach to annex such territory without notice
and hearing by the legislative body and without an election.
