A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
A REVISED AGREEMENT WITH THE DONALD L. BREN
COMPANY,.SUBDIVIDER, IN CONNECTION WITH THE
IMPROVEMENTS IN TRACT NO. 6620, AND AUTHORIZING
RELEASE OF PREVIOUSLY EXECUTED BONDS
WHEREAS, on June 10, 1968, by Resolution No. 6791, the
City Council of the City of Newport Beach approved an agreement
in which the Donald L. Bren Company, subdivider of Tract No. 6620,
agreed to construct street and other public improvements
necessary to serve said subdivision; and
WHEREAS, subdivider furnished security to assure the
faithful performance under said agreement in accordance with the
Newport Beach Municipal Code; and
WHEREAS, the subdivider has requested an extension of
time to complete the above - ground improvements in Tract No. 6620; and
WHEREAS, a revised agreement to construct street and
other public improvements together with new security bonds to cover
said improvements have been submitted to the City; and
WHEREAS, the City Council has reviewed said revised
agreement and found the same to be fair and equitable and in
accordance with the provisions of the Code;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
Clerk be and are hereby authorized and directed to execute the
revised agreement on behalf of the City of Newport Beach at such
time as said security is approved by the City Manager as to
sufficiency and the City Attorney as to form;
BE IT FURTHER RESOLVED that the City Clerk is authorized
to release the previously executed bonds now held by the City.
