A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NE'cTPORT BEACH AUTHORIZING THE ZIMCUTION
OF AN AGREEMENT WITH DONALD L. BREN CO.,
SUBDIVIDERS, FOR THE CONSTRUCTION OF PUBLIC
• IMPROVEPiLNTS IN TRACT NO.6565
WHEREAS, there has been presented to the City
Council of the City of Newport Beach an agreement in which
Donald L. Bren Co., subdivider of a portion of Tract No. 6565,
agrees to construct certain street and other public improve-
ments in the future; said streets and other public improve-
ments are necessary to serve said subdivision but dedication
of them at this time has been rejected by the City; and
WHEREAS, the City Council has reviewed said agree-
meat and found the same to be fair and equitable and in
accordance with the provisions of the Code; and
WHEREAS, the City Council adopted Resolution No.
6984 authorizing the execution of a similar agreement with
Newport Hills, Inc., a wholly owned subsidiary of Donald L.
Bren Co., for the construction of public improvements in
Tract No. 6565.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and
City Clerk be and hereby are authorized and directed to execute
the agreement with Donald L. Bren Co. on behalf of the City of
Newport Beach at such time as said agreement is approved by the
City Manager as to sufficiency and the City Attorney as to form;
BE IT FURTIER RESOLVED that this resolution supersede
in every respect Resolution No. 6934.
ADOPTED this 23rd day of June, 1969.
