RESOLUTION NO, 7041
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CORRECTING AND MODIFYING
THE ASSESSMENT AND DIAGRAM MADE AND FILED BY
THE SUPERINTENDENT OF STREETS OF SAID CITY ON
THE 24th DAY OF JUNE, 1969, TO COVER THE
SUMS DOOR THE 61M, AND IMPROVEMENT CONSISTING
OF CERTAIN STREET AND ALLEY IMPROVEMENTS AND
APPURTENANT WORK IN "ASSESSMENT DISTRICT NO. 51"
AS CONTEMPLATED BY RESOLUTION OF INTENTION NO.
6879 OF SAID CITY; AND ORDERING AND DIRECTING
THE SUPERINTENDENT OF STREETS TO AMEND AND MODIFY
THE SAID ASSESSMENT AND DIAGRAM ON THE FACE
THEREOF IN ACCORDANCE HEREWITH
WHEREAS, the Superintendent of Streets of the City of
Newport Beach did on the 24th day of June, 1969, file with the
City Clerk of said City his assessment and diagram to cover the
sums due for the work of construction of certain street and alley
improvements and appurtenant work in "Assessment District No. 51 "
in said City, as said work is described in Resolution of Intention
No. 6879; and
WHEREAS, the City Clerk of this City gave notice in the
manner required by law of said assessment and that Monday, the
28th day of July, 1969, all persons interested in the work done or
in the assessment would be heard by the City Council; and
41HEREAS, the City Council now has said assessment and
diagram under consideration;
NOW9 THEREFORE, the City Council of the City of Newport
Beach DOES HEREBY DETERMINE, ORDER AND RESOLVE as follows:
Section 1: That the said assessment and diagram be and
the same hereby is corrected and modified in each and all of the
particulars as set forth in the "Schedule of Modifications"
attached hereto, marked Exhibit "A" and made a part hereof for all
purposes;
Section 2: That the Superintendent of Streets of the

1 City of Newport Beach be and he hereby is ordered, instructed and
2 directed to correct and modify the assessment and diagram in the
3 particulars hereinabove set forth in Section 1 hereof on the
4 assessment and diagram and thereafter return the said assessment
5 and diagram as so corrected and modified to this City Council;
6 Section 3: That where corrections and modifications
7 hereinabove ordered have been made in the amount of the assessment
8 on any particular parcel of land to be assessed, this City Council
9 does hereby find and determine that the amounts so fixed herein as
10 the amount of assessment is the proportionate benefit received by
11 the said lot of land as to which said assessment is affixed;
12 Section 4: The City Clerk shall certify to this
13 resolution and a certified copy thereof shall be attached to the
14 assessment.
15 ADOPTED, SIGNED AND APPROVED this 28th day of July, 1969.

SCHEDULE OF MODIFICATIONS
1. Assessment Numbers 19 and
A. Modify the Assessment Diagram by inserting a "cut -line" to show the
southeasterly 4 feet of Lot 5, Block H and tie the said 4 feet to
Lot 4, Block H;
B. Modify the mount of the assessment on Assessment Number 19 to read:

C. Modify the amount of the assessment on Assessment Number 20 to read:
$387.42;
2. Assessment Number 354:
Modify the Assessment Roll and Diagram to read as follows:
A. Assessment Number 354: Lot 12, Block 129, Lake Tract, Book 4, Page 13,
Miscellaneous Maps, Records of Orange County, California to be assessed
in the amount of $120.81;
B. Assessment Number 354 -A: A parcel of land described as follows:
Bounded on the southwest by Lot 12, Block 129, Lake Tract, Book 4,
Page 13, Miscellaneous Maps, Records of Orange County, California;
bounded on the northwest by the alley in said Block 129; and bounded
easterly by that portion of Sections 28 and 33, Township 6 South,
Range 10 West, SBB &M described as Parcel 3, in Deed to the City of
Newport Beach, recorded June 20, 1960, in Book 5297, Page 63, of Official
Records, County of Orange, State of California, to be assessed in
the amount of $120.80.
