HomeMy WebLinkAbout7087 - Civil Action Against Certain Automobile ManufacturersRESOLUTION N0, 7 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE ATTORNEY GENERAL OF THE STATE OF CALIFORNIA TO REPRESENT THE CITY OF NEWPORT BEACH IN A CIVIL ANTI -TRUST ACTION AGAINST CERTAIN AUTOMOBILE MANUFACTURERS WHEREAS, the Attorney General of the State of California is considering the filing of an action on behalf of the State of California and the cities and counties of the State against various automobile manufacturers, on the basis that said manu- facturers have conspired together to retard the research, develop- ment, manufacture and installation of motor vehicle air pollution control equipment; and WHEREAS, this City Council is willing to have the City of Newport Beach become a party to such litigation and to be represented by the Attorney General; NOW, THEREFORE, BE IT RESOLVED that the Attorney General of the State of California, or any of his authorized assistants or deputies, is hereby authorized to take such action on behalf of the City of Newport Beach as in his discretion may be deemed appropriate in the preparation, filing and prosecution of a civil anti -trust suit for damages and other legal relief against any automobile manufacturers which appear to have conspired to retard the introduction of smog control devices in the State of California; BE IT FURTHER RESOLVED that this authorization includes the authority to settle such litigation on such terms as the Attorney General, or any of his authorized assistants or deputies, may deem appropriate, and to delegate to the City of Newport Beach its proper and equitable share of any sum recovered as damages, -1- excepting the amount of attorneys' fees, costs and expenses incurred by the Attorney General as determined or approved by sothe court, whether by settlement, trial or otherwise.
