HomeMy WebLinkAbout7106 - Designating Surfing AreasRESOLUTION NO, 7 106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DESIGNATING SURFING AREAS AND ESTABLISHING REGULATIONS RELATING THERETO AND REPEALING RESOLUTION NO. 6840 WHEREAS, Sections 11.16.020 and 11.16.040 of the Newport Beach Municipal Code authorize the City Council to designate certain areas of the Pacific Ocean where surfing shall be permitted, specify the dates and hours when such surfing areas may be used for surfing, and regulate the use of surfing areas by swimmers; and WHEREAS, the City Council has determined that the following regulations should be adopted: NOW, THEREFORE9 BE IT RESOLVED THAT: Section 1. Surfing Areas Designated. Between June 10 and September 15 of each year, the following described areas of the Pacific Ocean are hereby designated as surfing areas: (a) Surfing Area No. 1. That area between the southerly extension of the easterly line of 19th Street and the westerly boundary of the City. (b) Surfing Area No. 2. That area between a line parallel to and two hundred (200) feet easterly of the East Jetty and a line parallel to and twenty (20) feet easterly of the East Jetty. (c) Surfing Area No. 3. That area commonly known as Little Corona Beach. Section 2. Hours Surfing Permitted. Between June 10 and September 15 of each year, subject to all limitations on use of the beaches, surfing shall be permitted as follows: (a) In Surfing Area No. 1, surfing shall 10 be permitted daily between the hours of 7 :30 a.m. (except that the area immediately west of the Newport Pier in front of the Ocean Front parking lot shall be open at 6 :00 a.m.) and -1- 12:00 noon, and between the hours of 4:00 p.m. and sunset, subject to discretionary closure at any time during said periods, pursuant to Sections 11.16.060 and 11.16.070 of the Municipal Code, as indicated by use of the blackball signal flag system. In addition, the City Manager, upon the recommendation of the Marine Safety Director, may approve the opening of an area not to exceed one block in width within Surfing Area No. 1 from 7:30 a.m. until sunset on specified days for purposes of surfing contests or other special events. (b) In Surfing Area No. 2, surfing shall be permitted daily between the hours of 6 :00 a.m. and 12:00 noon and between the hours of 2 :00 p.m. and sunset, subject to discretionary closure at any time during these periods pursuant to Sections 11.16.060 and 11.16.070 of the Municipal Code, as indicated by use of the blackball signal flag system. (c) In Surfing Area No. 3, surfing shall be permitted daily between the hours of 6 :00 a.m. and 12:00 noon and between the hours of 2-.00 p.m. and sunset, subject to discretionary closure at any time during these periods pursuant to Sections 11.16.060 and 11.16.070 of the Municipal Code, as indicated by use of the blackball signal flag system. Section 3. Surfing Prohibited. No person shall use or have in his possession any surfboard, paddleboard, or similar device between June 10 and September 15 of each year, both dates inclusive, at any place in the Pacific Ocean within the City except within an area where surfing is permitted and during hours surfing is permitted within such area as provided in Sections 1 and 2 above. Subject to the provisions of Sections 11.16.050, 11.16.060, 11.16.070 and 11.16.090 of the Newport Beach Municipal 16 Code, after September 15 and before June 10 of each year, surf- ing is permitted any place in the City. -2- Section 4. Swimming Prohibited in Surfing Area No. 2. No person shall wade, bathe, or swim between June 10 and September 15 of each year, both dates inclusive, in Surfing 0 Area No. 2 designated in Section 1 hereof at any time surfing is permitted in such area unless such person has in his possession and is actually using a surfboard, paddleboard, or similar device. BE IT FURTHER RESOLVED that Resolution No. 6840 is hereby repealed. ADOPTED this 8th day of December , 1969.
