A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DIRECTING THE CITY ATTORNEY
• TO PREPARE AN OBJECTIVE ANALYSIS OF THE PROPOSED
AMENDED LEASE BETWEEN THE CITY AND THE BALBOA
BAY CLUB AND INSTRUCTING THE CITY CLERK TO SEND
A COPY OF SAID ANALYSIS TOGETHER WITH A COPY OF
THE PROPOSED AMENDED LEASE TO THE QUALIFIED
VOTERS OF THE CITY WITH THE SAMPLE BALLOT
WHEREAS, on the 17th day of November, 1969, the City
Council of the City of Newport Beach adopted Resolution No. 7100
which called a special election to be held on January 13, 19700
for the purpose of submitting a proposition to the qualified
voters of the City pertaining to the leasing of City property
to the Balboa Bay Club, Inc.; and
WHEREAS, the City Council has determined that in
accordance with Section 420 of the City Charter a copy of the
proposed amended lease between the City and the Balboa Bay Club,
Inc., should be transmitted to each qualified voter of the City
with the sample ballot; and
WHEREAS, the City Council has also determined that
because of the length and legal complexity of the amended lease
it would be helpful to the voters if an objective summary and
analysis of the amended lease were prepared by the City Attorney
and transmitted to each qualified voter together with a copy of
the amended lease and the sample ballot;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach, as follows:
SECTION 1. The City Attorney is directed to prepare
an objective analysis of the proposed amended lease between the
City and the Balboa Bay Club, Inc., which analysis shall include
a comparison of the major provisions of the proposed amended
lease with the provisions of the existing lease;

SECTION 2. The City Clerk is directed to transmit
in the envelope containing the sample ballot for the special
election to be held on January 13, 1970, a copy of the proposed
. amended lease and a copy of the analysis to be prepared by the
City Attorney.
ADOPTED this 8th day of December, 1969.
