HomeMy WebLinkAbout7147 - Hazardous Conditions on West Newport BeachRESOLUTION NO. 7147 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADVISING THE U. S. ARMY CORPS OF ENGINEERS THAT HAZARDOUS CONDITIONS EXIST ON WEST NEWPORT BEACH AND THAT THE CITY WILL PLACE A CLAIM AGAINST THE CORPS OF ENGINEERS FOR REMEDIAL ACTION UNDERTAKEN BY THE CITY OF NEWPORT BEACH WHEREAS, the U. S. Army Corps of Engineers has completed the placing of approximately 750,000 yards of fill from the Santa Ana River on West Newport Beaches; and WHEREAS, the fill contains pockets of silt and undetermined quantities of rock which is objectionable matter to beach fill; and WHEREAS, the objectionable material is contrary to the provisions of paragraph 5.1 of Section 3B of the 1 °Specifications for Restoration of Santa Ana River Channel" published by the Corps of Engineers; and WHEREAS, the rock material constitutes a present and continuing serious hazard to public safety and a severe impairment of City beach cleaning operations; and WHEREAS, the City Council has authorized additional funds and directed immediate remedial operations in the interests of public safety; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach, as follows: It is the intention of the City to press claims against the U. S. Army Corps of Engineers for remuneration of all expenses incurred in the removal of rock from fill material placed on West Newport beaches as a part of the Corps of Engineers project for restoration of the Santa Ana River Channel.
