• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION.
OF AN AGREEMENT BETWEEN -THE CITY OF NEWPORT
BEACH AND DONALD L, BREN COMPANY FOR THE
CONSTRUCTION OF-STREET AND OTHER PUBLIC
IMPROVEMENTS IN CONNECTION WITH TRACT.NO.
7028, EXCEPT MAC ARTHUR.BOULEVARD ND THE
MAIN LINE STORM DRAIN
WHEREAS, there has been presented to the City Council
of the City of Newport Beach, an agreement in which DONALD L.
BREN COMPANY agrees to construct street and other public
improvements necessary to serve Tract No. 7028, except Mac Arthur
Boulevard and the main line storm drains and
WHEREAS, Donald L. Bren Company has furnished security
to assure the faithful performance under said agreement in
accordance with the Newport Beach Municipal Code; and
WHEREAS, the City Council has reviewed said agreement
and found the same to be fair and equitable and in accordance
with the provisions of the Code;
NOW, THEREFORE, BE IT RESOLVED that said agreement for
the construction of said improvements is approved, and the Mayor
and City Clerk are hereby authorized and directed to execute
the same on behalf of the City of Newport Beach at such time as
said security is approved by the City Manager as to sufficiency
and the City Attorney as to form.
