A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF VEWPORT BEACH
AUTHORIZING THE EXECUTION OF AN
•
AGREEMENT WITH THE ORIGINAL HOUSE
OF PIES, INCORPORATED REGARDING
OFF SITE PARKING
WHEREAS, The Original House of Pies, Incorporated,
is the owner of that certain real property located in the
City of Newport Beach, County of Orange, State of California,
known as Lots 3 through 8 inclusive, Block 431, Lancaster °s
Addition to Newport Beach as per map recorded in Book 5,
Page 14 of Miscellaneous Maps, records of Orange County;
and
WHEREAS, The Original House of Pies, Incorporated,
proposes to construct and operate a restaurant on said
Parcels 3 through 8 with a seating capacity for 74 persons;
and
WHEREAS, The Newport Beach Municipal Code will
require a total of 25 parking spaces be provided on site
to accomodate a seating capacity of 74 persons plus 2
additional parking spaces to accomodate the retail sales
area for a total of twenty seven (27) spaces; and
WHEREAS, The Original House of Pies, Incorporated
has agreed that there shall be reserved for the benefit of
the customers of said restaurant not less than twenty seven
(27) parking spaces located on those Parcels 3 through 8
not occupied by the restaurant building.
WHEREAS, The Newport Beach Municipal Code allows
off street parking to be provided on a site other than the

building site on condition that an agreement between the

property owner and the City is executed and recorded
0 setting forth that the off street parking shall be
provided and maintained as a designated parcel of land
• for the duration of the proposed use or uses on the
building site or sites;
NOW, THEREFORE, BE IT RESOLVED that the
City Council hereby approvessaid agreement wherein
The Original House of Pies, Incorporated, shall provide
twenty seven (27) parking spaces located on those
parcels contiguous to the building site for the use and
benefit of the customers and business invitees of the
restaurant; and the Mayor and City Clerk are authorized
and directed to execute the same on behalf of the City;
BE IT FURTHER RESOLVED, that the City Clerk
is authorized and directed to record said agreement
and execute any certificate necessary to accomplish
said recording.
