RESOLUTION NO. 7247
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ASKING THE ASSISTANCE OF.THE
HONORABLE. ROBERT BADHAM, ASSEMBLYMAN FOR THE
71ST DYSTRICT, IN REQUESTING ".OPINION FROM
THE ATTORNEY.GENERAL OF THE STATE OF CALIFORNIA
CONCERNING_THE DUTY OF THE BOARD OF.SUFERVISORS
OF ORANGE COUNTY TO APPOINT. AN AIRPORT LAND USE
COMMISSION PURSUANT TO THE PROVISIONS OF .
DIVISION 9, ARTICLE 3.5 OF THE PUBLIC UTILITIES
CODE OF THE STATE. -OF CALIFORNIA.
WHEREAS, Division 9 of Article 3.5 of the California
Public Utilities Code provides for the creation of an Airport
Land Use Commission in each county containing at least one
airport operated for the benefit of the general public and
served by an air carrier certified by the Public Utilities
Commission or the Civil Aeronautics Board; and
WHEREAS, Orange County qualifies under said legislation
as a county in which an Airport Land Use Commission should be
created; and
WHEREAS, the Orange County Board of Supervisors has
declined to appoint an Airport Land Use Commission as required
by the aforesaid statute;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach does hereby ask the assistance of
the Honorable Robert Badham, Assemblyman for the 71st District,
in requesting that the Attorney General of the State of
California be asked to prepare a legal opinion on the question
of whether or not the Orange County Board of Supervisors is
under a legal duty to appoint'an Airport Land Use Commission
