Home My WebLink About7311 - Annexation 70 - Harbor View HillsRESOLUTION NO. 7 31 A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING THE ANNEXATION TO THE CITY OF CERTAIN UNINHABITED TERRITORY • CONTIGUOUS TO THE CITY OF NEWPORT BEACH AND KNOWN AS ANNEXATION NO. 70, HARBOR VIEW HILLS - PHASE 3 • WHEREAS, on July 8, 1970, the Local Agency Formation Commission of Orange County approved the proposed annexation to the City of Newport Beach of that certain territory as hereinafter described, designated as Annexation No. 70, Harbor View Hills - Phase 3, pursuant to the application filed by The Irvine Company as one of the owners of the territory to be annexed; and WHEREAS, on October 14, 1970, the Local Agency Formation Commission of Orange County approved the request of the City of Newport Beach requesting that the City Council be authorized to annex said territory without notice and hearing pursuant to Section 54797.1 of the Government Code, after proof having been submitted to said Commission that all of the owners of the land within the territory proposed to be annexed had given their written consent to such annexation; and WHEREAS, it appears that the necessary proceedings in accordance with the requirements of the Annexation of Uninhabited Territory Act of 1939 have been completed; NOW, THEREFORE, the City Council of the City of Newport Beach HEREBY RESOLVES as follows: Section 1: The annexation to the City of Newport Beach, California, of that certain uninhabited territory contiguous to said City, known as Annexation No. 70, Harbor View Hills - Phase 3, is hereby approved; said property is more particularly -1- described as follows: That portion of Blocks 91, 92, 97, 98 and 129 of Irvine's Subdivision, in the County of Orange, State of California, as per map filed in Book 1, page 88 of Miscellaneous • Record Maps in the office of the County Recorder of said County, described as follows: Commencing at the Southwest one - quarter corner of said Block 97, said corner being in the boundary of the City of Newport Beach as established by Annexation No. 57 per Resolution No. 6247 of said City; thence North 490 23' 25" West 212.08 feet along the Southwest line of said Block and boundary to a point on a non - tangent curve concave Northerly having a radius of 1940.00 feet and the True Point of Beginning, a radial to said point bears South 8° 43' 23" East; thence leaving said Boundary Easterly 100.68 feet along said curve through an angle of 2° 58' 25 "; thence North 78" 18' 12" East 91.45 feet to the beginning of a curve concave Southerly having a radius of 2060.00 feet; thence Easterly 1025.97 feet along said curve through an angle of 28° 32' 09 "; thence South 730 09'39" East 1316.69 feet to the beginning of a curve concave Northerly having a radius of 1940.00 feet; thence Easterly 487.88 feet along said curve through an angle of 14° 24' 32 "; thence South 87° 34' 11" East 626.85 feet; thence North 13° 30' 09" West 2148.40 feet to an angle point in the boundary of that certain parcel of land described in the deed to the Irvine Ranch Water District, recorded June 4, 1965, in Book 7545, page 621 of Official Records of said County, said angle point being the Easterly terminus of that certain course described as "South 75° 55' 07" West 289.80 feet" in said deed; thence along the Southerly, Westerly and Northerly boundary of said land, the following courses and distances: South 76° 29' 51" West 289.80 feet; North 21" 42' 29" West 1261.95 feet; North 11" 55' 07" West 448.09 feet; North 220 17' 55" West 454.58 feet; North 50" 46' 05" West 77.21 feet; North 150 18' 07" West 276.97 feet; North 40° 11' 36" West 369.92 feet; North 25° 45' 17" West 585.41 feet; North 320 07' 13" East 138.22 feet; thence southwesterly 1078.58 feet along first mentioned curve through an angle of 30" 53' 56" isto an angle point in said boundary; thence along said -2- L • boundary the following courses and distances: South 17" 16' 46" East 35.21 feet to the beginning of a curve concave Westerly having a radius of 2000.00 feet; Southerly 1648.98 feet along said curve through an angle of 47° 14' 23 "; South 29° 57' 37" West 1703.92 feet to the beginning of a curve concave Northwesterly having a radius of 4000.00 feet; thence Southwesterly 284.97 feet along said curve through an angle of 4° 04' 56" to an angle point in the boundary of the City of Newport Beach as established by Annexation No. 62 per Resolution No. 6913 of said City; thence Southwesterly 788.95 feet along said curve and boundary through an angle of 11° 18' 03 "; thence South 440 39' 24" East 50.00 feet along said boundary to the Northwesterly line of the land described in the deed to Pacific View Memorial Park recorded January 10, 1962 in Book 5970, page 522 of said Official Records; thence along the Northwesterly, Northeasterly and Southeasterly line of said land as described in said deed and a deed recorded December 17, 1958 in Book 4518; page 207 of said Official Records, the following courses and distances; North 45° 20' 36" East 1017.15 feet; South 490 26' 33" East 1116.84 feet; South 210 30' 58" East 400.00 feet; South 57° 20' 58" East 270.00 feet; South 29° 10' 29" East 793.69 feet; South 40 °23' 08" West 2136.41 feet to an angle point in the boundary of the City of Newport Beach as established by said Annexation No. 57; thence South 490 23' 25" East along said boundary 353.42 feet to the True Point of Beginning. Section 2: The above parcel of property legally described in Section 1 shall be subjected to taxation after annexation equally with property within the City of Newport Beach to pay any indebtedness and liabilities of the City of Newport Beach outstanding, contracted, authorized, or existing prior to, or at the time of annexation, EXCEPT that portion thereof as described in the Deed to the Metropolitan Water District of Southern California, recorded in Book 1212, page 381 of Official Records in the Office of the County Recorder of said Orange County.
