A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ACCEPTING THE DEDICATION FOR FRFF-
to PUBLIC STREET PURPOSES OF A PORTION OF MACARTHUR C4
BOULEVARD WITHIN SUBDIVISION TRACT NO. 6565
WHEREAS, on May 12, 1969, the City Council approved
a final subdivision map for Tract No. 6565, which was recorded
in Book 257 of Miscellaneous Maps, pages 14 -19, records of
Orange County; and
WHEREAS, said subdivision map contained an offer to
dedicate a certain easement for public street purposes over a
portion of MacArthur Boulevard; and
WHEREAS, at the time it approved said subdivision map
the City Council rejected said offer; and
WHEREAS, Section 11616 of the Business and Professions
Code of the State of California provides: "I£ at the time the
final map is approved any streets... are rejected, the offer of
dedication shall remain open, and the goUerning body may by
resolution at any later date, and without further action by
the subdivider, rescind its action and accept and open the
streets ... for public use, which acceptance shall be recorded
in the Office of the County Recorder "; and
WHEREAS, the City Council has determined that the
public interest requires that it rescind its prior action and
accept the offer of dedication of said easement as shown upon
Exhibit "A" which is attached hereto and incorporated by
reference herein;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach, as follows:
SECTION 1. The prior action of the City Council in
rejecting the offer to dedicate said easement as shown on
Exhibit "A" is hereby rescinded and the area within said
easement is hereby accepted and dedicated for public street
purposes.
SECTION 2. The City Clerk is directed to cause this
resolution to be recorded in the Office of the County Recorder
of Orange County.
ADOPTED this 14th day of December, 1970.
