A RESOLUTION OF INTENTION OF THE CITY COUNCIL
•OF THE CITY OF NEWPORT BEACH DECLARING ITS
• INTENTION TO ORDER THE VACATION OF A SEWER
LINE EASEMENT AT EL PASEO DRIVE AND BAYSIDE
DRIVE
The City Council of the City of Newport Beach,
pursuant to the provisions of the "Public Service Easements
Vacation Law" and all amendments thereto, being Sections
50430, et.seq., of the Government Code of the State of
California, does hereby resolve and declare as follows:
SECTION 1. The public interest and convenience
require, and it is the intention of the City. Council of the
City of Newport Beach to order, the vacation of a certain
sewer easement in, over and under that certain real property
in the City of Newport Beach, County of Orange, State of
California, described as follows:
That certain easement granted to the City of Newport
Beach for sewer pump station and main as described in
the deed recorded in Book 4843, Page 394, Official
Records of Orange County, and shown on Lot D, Tract
No. 6927, recorded in Book 265, Page 17 of Miscellaneous
Maps of said county.
Said easement to be vacated is shown on a certain
map entitled "Vacation of easement for sewer pump station and
main, Lot D, Tract 6927" being City of Newport Beach Public
Works Department drawing No. R/W- 5188 -L, dated September 26,
1970, a copy of which is marked Exhibit "A" and attached hereto
and by this reference made a part hereof, and which shall be
kept on file in the office of the City Clerk as a part of this
resolution.

SECTION 2. The proceedings for the vacation of said
easement are taken pursuant to, and the City Council of the
City of Newport Beach hereby elects to proceed under the pro-
visions of, the "Public Service Easements Vacation Law" and
all amendments thereto, being Sections 50430 to 50445, inclusive,
of the Government Code of the State of California.
SECTION 3. The Public Works Director of the City of
Newport Beach shall cause to be conspicuously posted along the
line of said easement proposed to be vacated, not more than
300 feet apart and not less than three in all, notices of the
vacation of said easement. The notices shall state the passage
of this resolution of intention and the time and place of the
hearing before the City Council of all persons interested in
or objecting to the proposed vacation. Said notices shall be
posted at least ten days before the date of said hearing.
SECTION 4. Notice is hereby given that the City
Council of the City of Newport Beach does hereby fix Monday,
the it TH day of 4TAMdgtt Ir 4 7 1 , at the hour of 7:30
o'clock P.M. on said day in the Council Chamber located in the
City Hall of the City of Newport Beach at 3300 Newport Boulevard,
Newport Beach, California, as the time and place for hearing all
persons interested in or objecting to the proposed vacation of
said easement.
SECTION 5. A notice of the hearing hereinbefore set,
giving the date, time and place of said hearing, shall be
published by the City Clerk in the official newspaper of the
City once each week for at least two successive weeks prior to
said hearing.
ADOPTED this 14th day of December, 1970.
