RESOLUTION NO. 7330
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING THE ANNEXATION TO
THE CITY OF CERTAIN UNINHABITED TERRITORY
CONTIGUOUS TO THE CITY OF NEWPORT BEACH AND
KNOWN AS SUPERIOR AVENUE - HOSPITAL ROAD
• ANNEXATION NO. 74
WHEREAS, on November 25, 1970, the Local Agency Formation
Commission of Orange County approved the proposed annexation to the
City of Newport Beach of that certain territory as hereinafter
described, designated as Superior Avenue - Hospital Road Annexation
No. 74, pursuant to the application filed by William Cagney, the
owner of the territory to be annexed; and
WHEREAS, on November 25, 1970, the Local Agency Formation
Commission of Orange County approved the request of the City of
Newport Beach requesting that the City Council be authorized to
annex said territory without notice and hearing pursuant to
Section 54797.1 of the Government Code, after proof having been

submitted to said Commission that all of the owners of the land
within the territory proposed to be annexed had given their written
consent to such annexation; and
WHEREAS, it appears that the necessary proceedings in
accordance with the requirements of the Annexation of Uninhabited
Territory Act of 1939 have been completed;
NOW, THEREFORE, the City Council of the City of Newport
Beach HEREBY RESOLVES as follows:
SECTION 1. The annexation to the City of Newport Beach,
California, of that certain uninhabited territory contiguous to
said City, known as Superior Avenue - Hospital Road Annexation No.
74, is hereby approved; said property is more particularly
described as follows:
• Portion of Lot D, Banning Tract, Superior Court Case 6385,
Los Angeles County, California, portion of Lot 1, Tract
463, as shown on a Map thereof, recorded in book 32,

pages 2 and 3 of Miscellaneous Maps, Records of Orange
County, California, and a portion of Lot 1, Tract 2250,
as shown on a Map thereof, recorded in book 104, pages
6 and 7 of Miscellaneous Maps, Records of said Orange
County, and that portion of Lot 172 in Block 1 and Lot
169 in Block 2 of Irvine's Subdivision in the County
of Orange, State of California, as per map recorded in
book 1 page 88 of Miscellaneous Maps in the office of the
County Recorder of said County, described as follows:
Beginning at the most Northwesterly corner of Parcel 1
of the land described in the deed to the Presbyterian
Hospital of Orange County recorded February 8, 1946 in
book 1398 page 20 of Official Records of said County;
being an angle point in the existing boundary line of
the City of Newport Beach, as described in Ordinance
No. 558 adopted by the City Council of the City of
Newport Beach; thence along the Westerly line of said
Parcel 1 and said existing boundary the following
courses, S 10° 29' 46" E 190.75 feet, Southeasterly
along a tangent curve concave Northeasterly with a
radius of 1000.00 feet, a distance of 224.00 feet
through a central angle of 12° 50' 04 ", tangent to
said curve S 23° 19' 50" E 253.42 feet, Southeasterly
along a tangent curve concave Northeasterly with a
radius of 409.51 feet a distance of 112.10 feet through
a central angle of 15° 41' 02 ", Southeasterly along a
reverse curve concave Southwesterly with a radius of
514.46 feet a distance of 112.34 feet through a central
angle of 120 30' 43" and tangent to said curve S 26 °30109"
E 539.48 feet to an angle point in the existing boundary
line of the City of Newport Beach, as described in
Annexation No. 65 to the City of Newport Beach; thence
leaving the boundary described in said Ordinance No. 558
and along the boundary of said Annexation No. 65 the
following courses, S 54° 42' 28" W 123.87 feet, S
470 41' 29" W 110.55 feet, Southwesterly along a tangent
curve concave Southeasterly with a radius of 450.00 feet
a distance of 141.95 feet through a central angle of
180 04' 25 ", non - tangent to said curve S 70° 47' 57"
W 108.90 feet and N 86° 13' 59" W 201.28 feet to an
angle point in said Annexation No. 65 being on the
boundary line of the City of Newport Beach, as described
in Parcel No. 4 of Ordinance No. 683 adopted by the City
Council of the City of Newport Beach; thence leaving the
boundary described in said Annexation No. 65 and along
the boundary of said Parcel No. 4 of Ordinance No. 683
the following courses, N 800 31' 50" W 1308.58 feet
Westerly along a tangent curve concave Northerly with
• radius of 1450.00 feet a distance of 264.70 feet through
• central angle of 100 27' 34 ", tangent to said curve
N 700 04' 16" W 679.04 feet, Westerly along a tangent
curve concave Northerly with a radius of 950.00 feet a
distance of 195.69 feet through a central angle of
110 48' 09" to an angle point in the existing
boundary line of the City
of Newport Beach, as described in Annexation No. 55
to the City of Newport Beach; thence leaving the
boundary described in said Parcel No. 4 of Ordinance
No. 683 and along the boundary of said Annexation No.
55 the following courses, Northeasterly along a non-
tangent curve concave Southeasterly with a radius of
290.00 feet a distance of 273.98 feet through a central

angle of 54° 07' 43 ", tangent to said curve S 72° 54' 30"
E 281.95 feet, Southeasterly along a tangent curve concave
Northerly with a radius of 343.48 feet a distance of 93.94
feet through a central angle of 15° 40' 15 ", non - tangent
to said curve N 5° 46' 58" W 234.53 feet Northeasterly
• along a non - tangent curve concave Northwesterly with a
radius of 450.00 feet a distance of 235.10 feet through
• a central angle of 29° 56' 00 ", and tangent to said curve
N 390 41' 15" E 75.42 feet to an angle point in the
existing boundary line of the City of Newport Beach as
described in Annexation No. 54 to the City of Newport
Beach, thence leaving the boundary described in said
Annexation No. 55 and along the boundary of said
Annexation No. 54 the following courses, Southeasterly
along a non - tangent curve concave Southwesterly with a
radius of 730.00 feet a distance of 130.21 feet through
a central angle of 100 13' 12 ", tangent to said curve
S 500 18' 45" E 152.00 feet and N 390 41' 15" E 705.55
feet to an angle point in said Annexation No. 54 being
in the Northwesterly line of said Lot 172; thence leaving
said existing boundary line and continuing along said
Northwesterly line N 390 41' 15" E 314.29 feet to the
most Westerly corner of the land shown on a map filed
in book 1 page 35 of .Parcel Maps in the office of the
County Recorder of said County; thence along the
Southerly line of said land S 890 45' 35" E 470.86 feet
to an angle point in the existing boundary line of the
City of Newport Beach, as described in Annexation No. 58
to the City of Newport Beach; thence along said existing
boundary and continuing along said Southerly line
S 890 45' 35" E 192.75 feet to the point of beginning.
SECTION 2. The following portion of the parcel of
property legally described in Section 1 shall be subjected to
taxation after annexation equally with property within the City
of Newport Beach to pay any indebtedness and liabilities of
the City of Newport Beach outstanding, contracted, authorized,
or existing prior to, or at the time of annexation:
That portion of Lot 172 in Block 1 and Lot 169 in Block
2 of Irvine's Subdivision in the County of Orange, State
of California, as per map recorded in book 1, page 88-of
Miscellaneous Maps in the office of the County Recorder
of said County, described as follows:
Beginning at the most Northwesterly corner of Parcel 1
of the land described in the deed to the Presbyterian
Hospital of Orange County recorded February 8, 1946 in

the City of Newport Beach, as described in Ordinance

curve concave. Southwesterly with a radius of 514.46
feet a distance of 112.34 feet through a central angle
of 12° 30' 43" and tangent to said curve S 26° 30' 09"
E 149.45 feet to the Northeasterly corner of the land
described as Parcel 1B in the Final Order of Condemnation
recorded January 5, 1965 in book 7370 page 86 of Official
Records of said County; thence leaving said existing
boundary along the Northerly line of said Parcel 1B,
S 870 O1' 21" W 1222.43 feet to an angle point therein;
thence continuing along said Northerly line and the
Westerly prolongation thereof N 83° 00' 50" W 620.67
feet to the Northwesterly line of said Lot 172; thence
along said Northwesterly line N 39° 41' 15" E 210.69
feet to an angle point in the existing boundary line
of the City of Newport Beach, as described in Ordinance
No. 1068 adopted by said City Council; thence continuing
along said Northwesterly line and along said existing
boundary line N 390 41' 15" E 705.55 feet to an angle
point in said existing boundary line; thence leaving
said existing boundary line and continuing along said
Northwesterly line N 390 41' 15" E 314.29 feet to the
most Westerly corner of the land shown on a map filed
in book 1 page 35 of Parcel Maps in the office of the
County Recorder of said County; thence along the Southerly
line of said land S 890 45' 35" E 470.86 feet to an angle
point in the existing boundary line of the City of Newport
Beach, as described in Annexation No. 58 to the City of
Newport Beach; thence along said existing boundary and
continuing along said Southerly line S 89° 45' 35" E
192.75 feet to the point of beginning.
SECTION 3; The boundaries of the City of Newport Beach,
California, shall be, and the same are hereby altered to include
the territory described in Section 1 of this Resolution.
SECTION 4. The City Clerk is hereby directed to file
a certified copy of this Resolution with the Secretary of State.
