RESOLUTION NO. i 33 8
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AMENDING RESOLUTION
NO. 7308 WHICH ESTABLISHED UNDERGROUND
UTILITY DISTRICT NO. 1
WHEREAS, on November 23, 1970, the City Council of
the City of Newport Beach adopted Resolution No. 7308, entitled
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 1 AND ORDERING
THE REMOVAL OF POLES, OVERHEAD WIRES AND ASSOCIATED OVERHEAD
STRUCTURES AND THE UNDERGROUND INSTALLATION OF WIRES AND
FACILITIES FOR SUPPLYING ELECTRIC, COMMUNICATION, OR SIMILAR OR
ASSOCIATED SERVICE WITHIN THAT AREA OF THE CITY LOCATED WITHIN
SAID DISTRICT "; and
WHEREAS, in order for the Southern California Edison
Company to expend funds to replace its existing overhead distri-
bution facilities with underground distribution facilities within
said district, it is necessary that the City Council make certain
findings pursuant to Rule No. 20 of the California Public Utilities
Commission;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that Section 1 of said Resolution
No. 7308 is hereby amended by adding the following language at
the end of said section:
"Further, that the Council hereby finds and determines
as follows:
"The Underground Utility District herein created is
in the general public interest for the following reason(s):
The said streets, roads or rights -of -way adjoin or pass
through an area of unusual scenic interest to the general
public."
ADOPTED this 21st day of December, 1970.
