RESOLUTION NO. 7 3 44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH RECOMMENDING THAT THE CHIEF
OF THE FIRE DEPARTMENT BE DESIGNATED AS THE
ISSUING AUTHORITY FOR EXPLOSIVES PERMITS
PURSUANT TO SECTION 12007 OF THE HEALTH AND
SAFETY CODE
WHEREAS, the 1970 Legislature has enacted into law
Section 12007 of the Health and Safety Code providing compre-
hensive explosives controls, delegating to the head of a
municipal police department the responsibility for the issuance
of explosives permits; and
WHEREAS, in addition, said section provides that
the governing body of any city may designate as an issuing
authority within its jurisdiction the chief of a full -time pro-
fessional fire department; and
WHEREAS, the Newport Beach Fire Chief has in the past
had this authority; and
WHEREAS, it would be desirable for this responsibility
to be retained by the Chief of the Fire Department;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the Chief of the Newport Beach
Fire Department is hereby authorized and designated as the
issuing authority for explosives permits in the City of Newport
Beach.
ADOPTED this 21st day of December, 1970.
