HomeMy WebLinkAbout7435 - Space EasementRESOLUTION NO. 7435 A RESOLUTION OF THE CITY COUNCIL OF THE CITY • OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH, THE IRVINE COMPANY, AND KAISER AETNA, A PARTNERSHIP, IN CONNECTION WITH A SPACE EASEMENT WHEREAS, The Irvine Company is the owner of that certain real property located in the City of Newport Beach, w b Q more commonly known as 369 San Miguel Drive (subject property); and WHEREAS, Kaiser Aetna is the Lessee by assignment of the subject property under a long term ground lease agreement between Lessor and Lee Development Company, dated September 9, 1969; and WHEREAS, Lessee proposes to construct a three story professional building on the subject property with increased floor area as permitted by Section 506, subsection 1, of the Uniform Building Code by providing an increase in the separation of the building on two sides; and WHEREAS, The Irvine Company and Kaiser Aetna have agreed to keep said separation of the building on two sides free and clear of any obstructions for the term of their ground lease agreement; NOW, THEREFORE, BE IT RESOLVED that said agreement for the space easement above described is approved and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach. � o ca ATTEST li m City Clerk ADOPTED this 24th day of Max , 1971. e Mayor DO'N:adw 3/5/71
