OF NEWPORT BEACH ASSESSING THE COST OF CONSTRUCTING STREET IMPROVEMENTS AGAINST CERTAIN REAL PROPERTY PURSUANT TO THE PROVISIONS OF CHAPTER 27, DIVISION 7, OF THE STREETS & HIGHWAYS CODE (WEST SIDE OF IRVINE AVENUE FROM 21ST STREET SOUTHERLY TO CITY BOUNDARY) WHEREAS, on June 22, 1970, the City Council directed the Public Works Director (acting as Superintendent of Streets) to notify the owners of the real property located on the west side of Irvine Avenue from 21st Street southerly to the City boundary, to construct curb, gutter and pavement in accordance with the procedure set forth in Chapter 27, Division 7 of the Streets & Highways Code; and WHEREAS, notice was given to each owner or person in possession pursuant to the requirements of Section 5877 of the Streets & Highways Code, and on the 27th day of July, 1970, a public hearing was held by the City Council to consider protests and objections to the proposed improvements; and WHEREAS, after the close of said hearing the City Council after passing upon such objections or protests ordered that the improvements be constructed; and WHEREAS, the Superintendent of Streets has completed the construction of said improvements and has given notice of the cost of the construction to the owners or persons in possession of the affected property and has filed a report with the City Council specifying the workmanship which has been done, the cost of construction and other information as required by Section 5882 of the Streets & Highways Code; and . WHEREAS, on the 24th day of May, 1971, the City Council held a hearing for the purpose of passing upon the report of the Superintendent of Streets and to hear any objection -1- • or protests by property owners liable to be assessed for such construction, and any other interested persons; NOW, THEREFORE, the City Council of the City of Newport Beach does hereby RESOLVE, DECLARE AND ORDER, as follows: SECTION 1. The report filed by the Public Works Department dated May 24, 1971, concerning the improvement work completed on the west side of Irvine Avenue southerly of 21st Street to the City boundary, is hereby confirmed, and all protests by persons owning property liable to be assessed for such work are overruled. SECTION 2. The cost of the construction is hereby assessed against the parcels of property fronting upon the improve- ments so constructed, which parcels are described by the County Assessor's parcel number, and the amounts of the assessment applicable to each parcel are hereinafter set forth: Parcel No. Amount 1- 18- 302 -28 $ 911.64 1 -18- 302 -30 1,012.01 1 -18- 302 -29 1,129.53 1 -18- 302 -31 1,039.50 1 -18- 302 -11 1,231.57 1 -18- 302 -10 1,185.49 1 -18- 302 -49 827.64 1 -18- 302 -51 1,117.49 SECTION 3. The assessments set forth in Section 2 hereof shall be a lien upon the respective parcel from the time of recordation of a Notice of Lien, which lien shall continue until the assessment and all interest thereon is paid, or until it is discharged of record. SECTION 4. The City Council hereby determines that the payment of the assessments set forth in Section 2 hereof may be paid in three equal annual installments which shall bear interest on the unpaid balance at the rate of 6% per annum; said interest shall begin to run on the 31st day after the adoption of this -2- resolution by the City Council.
