A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH STATING ITS INTENTION TO RESTRICT
ACCESS ALONG THE OCEAN AND BAY FRONT RIGHTS OF
WAY TO PEDESTRIAN TRAVEL, AND AUTHORIZING THE
TRAFFIC ENGINEER TO POST THE AREAS WITH SIGNS
LIMITING THE ACCESS TO PEDESTRIAN USE AND BICYCLE
USE WHERE PERMITTED BY ORDINANCE
WHEREAS, there are certain ocean and bay front rights
of way within the City of Newport Beach which have been dedicated
for highway purposes; and
WHEREAS, said rights of way have been approved as
sidewalks; and
WHEREAS, Section 12.56.140 of the Newport Beach
Municipal Code prohibits the riding of bicycles upon any sidewalk
within the City, except that bicycles may be ridden on the south
one -half of the sidewalk located on Ocean Front between F Street
and McFadden Place and between the westerly line of the Ocean
Front Parking Lot and 36th Street; and
WHEREAS, the City Council has determined that it would
be in the best interests of the citizens of the City of Newport
Beach if said ocean and bay front rights of way were restricted
to pedestrian travel and bicycle use where permitted by ordinance,
and that automobiles should be prohibited along said rights of
way;
NOW,. THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach declares its intention to reclassify
the status of the ocean front and bay front rights of way from a
street and highway purpose to pedestrian walkways for the exclusive
use of pedestrian travel and the operation of bicycles where
permitted by Section 12.56.140 of the Newport Beach Municipal
Code;

BE IT FURTHER RESOLVED that the Newport Beach Traffic
Engineer be authorized to post said rights of way restricting
behicular access.
ADOPTED this 26th day of October, 1971.
