RESOLUTION NO. 2013 -41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH REJECTING AN IRREVOCABLE
OFFER OF DEDICATION FOR THE NEWPORT RIDGE
PARK AND CRESTRIDGE PARK PROPERTIES
WHEREAS, pursuant to that certain document entitled "San Joaquin Hills Local
Parks Irrevocable Offer of Dedication" recorded on April 8, 1993, as instrument No. 93-
0234810 in the Official Records ( "Official Records ") of Orange County, California (the
"Offer "), The Irvine Company, a Michigan Co,poration ( "TIC "), offer -.d for dedication to
the County of grange ( "County "), certain real property located in Orange County,
California known as Newport Ridge Park and Crestridge Park; and
WHEREAS, Newport Ridge Park and Crestridge Park are located within that land
area known as the Newport Coast, which land area was formed and located within the
unincorporate:i re-. of Orange County. California; and
WHEREAS, by virtue of the annexation of the Newport Coast by the City of
Newpo�l Bedco { °j'il; ; ^ffective January 1, 2002, County's rights under the Offer for the
Newport Ridge Park and Crestridgi Park were transferred to, and are now vester' in the
City, as evidenced by the Certificate of Completion filed by the Orange Local Agency
Formation Camrmsslon in the Official Records of Orange County on November 28,
2001, as instrument No. 200 i - `?849462; and
WHEW -:AS, Ne.voort Rage Park is composed of three separate and distinct
areas commonjy nrfown �tm- (1) ih4: :ornmuniiy Center parcel, which is labeled as Parcel
A on the map a;,a>hed hereto as Exhibit_ 1, which is incorporated herein by this
reference; (`?) he baseball fields parcel, which is labeled as Parcel B in Exhibit 1; and
(3) the tennis courts parcel, which is labeled as Parcel C in Exhibit 1; and
WHEREAS, on Aprii 25, 2006, the City Council adopted Resolution No. 2006 -31
accepting the Community Center parcel; and
WHEREAS, on April 25, 2006, the City Council adopted Resolution No. 2006 -32,
expressing and declaring its intent to endeavor to, at a future date, reject portions of the
Offer with respect to remaining property not previously accepted by the City; and
WHEREAS, the City Council of the City of Newport Beach now desires to reject
the Offer as to Parcel B, Parcel C and Crestridge Park
NOW THEREFORE, the City Council of the City of Newport Beach hereby
resolves as follows:
Section 1: Upon the effective date of this resolution, the City hereby rejects
the Offer for Parcel B, Parcel C and Crestridge, Park as depicted in Exhibit 1.
Section 2: The City Manager and City Clerk are authorized and hereby
directed to execute and file with the Office of the County Recorder for the County of
Orange any other documents that might be required to memorialize the rejection of the
Offer.
Section 3: This resolution shall become effective upon the execution of a valid
public access easement, that is acceptable as to form to the City Attorney, in favor of
the City for the sidewalk area along Coyote Canyon Landfill, Newport Ridge Drive and
San Joaquin Hills Road as well as any right -of -way between said streets and the
sidewalks. The City Clerk shall certify the vote adopting the resolution
ADOPTED this 14`h day of May, 2013.

regular meeting of said Council, duly and regularly held on the 141h day of May, 2013, and that the same
was so passed and adopted by the following vote, to wit:
