RESOLUTION NO. 7605
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING EXECUTION OF AN AGREEMENT
BETWEEN THE CITY OF NEWPORT BEACH AND THE ORANGE
COUNTY FLOOD CONTROL DISTRICT PROVIDING FOR THE
® CONVEYANCE OF AN EASEMENT AND RIGHT OF ENTRY IN
CONNECTION WITH THE CONSTRUCTION OF EAST NEWPORT
HEIGHTS STORM DRAINf AND AUTHORIZING EXECUTION
OF NECESSARY QUITCLAIM DEED AND RIGHT OF ENTRY
WHEREAS, by Resolution No. 7366 dated January 25, 1971,
the City of Newport Beach rescinded the original rejection of an
offer of dedication of certain storm drain easements, and formally
accepted said easements for storm drain purposes over certain
parcels of property in Tract 1218 in the East Newport Heights
area; and
WHEREAS, the Orange County Flood Control District pro-
poses to construct a storm drainage system across and adjacent
to said easements, and in connection therewith has requested
that the City enter into an agreement providing that the City,
assuming liability for any imperfection of title by reason of a
possible defect in title because of the original rejection and
subsequent acceptance of said easements, convey and grant to the
Orange County Flood Control District the following:
1. By Quitclaim deed, a certain portion of the above
described easements, legally described as:
That portion of Lots 18 and 148 of Tract No.
1218, in the City of Newport Beach, county of
Orange, state of California, per map recorded
in book 37, pages 47 to 49 inclusive of Miscel-
laneous Maps in the office of the County Recorder
of said county, included within those certain
strips of land shown on the map of said tract
as "201 Easement for Storm Drain ".
2. Right of entry to the remaining portion of said
easements, legally described as:

That portion of Lots 1 through 17 inclusive
of Tract No. 1218, in the City of Newport Beach,
county of Orange, state of California, per map
recorded in book 37, pages 47 to 49 inclusive
of Miscellaneous Maps in the office of the County
Recorder of said county, included within those
® strips of land shown on the map of said tract as
"20=' Easement for Storm Drain ",
WHEREAS, the City Council has considered the terms and
conditions of said agreement and found them to be fair and equitable;
NOW,, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement is approved, and
the Mayor and City Clerk are hereby authorized and directed to
execute the same on behalf of the City of Newport Beach,
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized and directed to execute a quitclaim deed
and a right of entry to the above described parcels of property.
