A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH OFFERING TO AGREE TO A MUTUAL
CANCELLATION OF THE ARCHITECTURAL AND
• ENGINEERING SERVICES CONTRACT BETWEEN THE CITY
OF NEWPORT BEACH AND WELTON BECRET AND ASSOCIATES
IN CONNECTION WITH DEVELOPMENT OF THE NEWPORT
BEACH CIVIC CENTER AT NEWPORT CENTER
WHEREAS, on August 12, 1969, the City of Newport Beach
and Welton Becket and Associates entered into a contract for
architectural and engineering services in connection with the
construction and development of the Newport Beach Civic Center
proposed to be located at the Newport Center site; and
WHEREAS, with the defeat of the bond financing election
on Tuesday, October 5, 1971, it was necessary to revise the
civic center construction program, plans and cost budget, and
Welton Becket and Associates were advised by letter dated
November 2, 1971, to stop and hold any further work in abeyance
pending direction from the City Council; and
WHEREAS, Welton Becket and Associates have performed
all obligations and services required under the terms of the
contract up to the date of notification to cease work, and have
received full payment from the City for said services; and
WHEREAS, the City now intends to examine the feasibility
of a project limited in scope to the expansion of the police
facilities only, on the existing Newport Beach City Hall site, in
lieu of the project outlined in the above contract, and has
determined that it would be in the best interests of the City to
enter into a mutual cancellation of said contract; and
WHEREAS, by letter dated February 2, 1972, Welton Becket
and Associates have indicated a willingness to agree with the City
• to mutually cancel said contract;

NOW& THEREFOREt BE IT RESOLVED by the City Council of
the City of Newport Beach that it hereby offers to agree to a
mutual cancellation of the above contract with Welton Becket and
Associates dated August 12, 1969;
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
hereby authorized to execute the necessary documents on behalf of
the City to effect said mutual cancellation, conditioned upon
both parties acknowledging full performance and payment for all
services to date of the agreed cancellation, including a mutual
release from any further claims, demands, liabilities and
obligations under said cancelled contract.
ADOPTED THIS 14th day of February, 1972.
