A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH REQUESTING THE STATE GEOLO-
GIST TO EXEMPT THE CITY OF NEWPORT BEACH FROM
THE PROVISIONS OF SECTION 2705 OF THE PUBLIC
RESOURCES CODE OF THE STATE OF CALIFORNIA PER-
TAINING TO THE COLLECTION OF FEES UNDER THE
STRONG MOTION INSTRUMENTATION PROGRAM
WHEREAS, Sections 2700 through 2708 of the Public Re-
sources Code of the State of California establish a strong motion
instrumentation program in the State of California, and
WHEREAS, Section 2705 of the Public Resources Code
of the State of California provides that all cities shall col-
lect a fee from all applicants for construction permits which
fees shall be equal to .007 percent of the estimated cost of the
structure; and
WHEREAS, Section 2708 of the Public Resources Code of
the State of California provides that a city may be exempted from
the provisions of Section 2705 if the City has adopted an ordinance
requiring the installation of accelerographs in structures, if a
minimum of one structure has been instrumented with three accelero-
graphs installed in accordance with such ordinance prior to
October 1, 1971, and if the governing body of such city presents
a written request to the State Geologist on or before June 30, 1972
requesting that the city be exempted from the provisions of Section
2705; and
WHEREAS, the City of Newport Beach on November 25, 1968
adopted Section 2314(1) of the 1967 Edition of the Uniform Building
Code which section requires the installation of accelerographs in
structures constructed within the City; and

WHEREAS, in November of 1970 three accelerographs were
installed in a building located at 620 Newport Center Drive in the
City of Newport Beach and in July of 1971 three accelerographs
adopted by the City.
NOW THEREFORE,; BE IT RESOLVED that the City Council of
the City of Newport Beach hereby authorizes and directs that a
certified copy of this resolution be presented to the State Geolo-
gist requesting said State Geologist to comply with said Public
Resources Code Section 2708 by exempting the City of Newport Beach
from the provisions of Public Resources Code Section 2705,
