HomeMy WebLinkAbout7701 - Balboa Boulevard WideningRESOLUTION NO. W 7® Y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ACCEPTING A GRANT DEED FROM THOMAS C. ROGERS IN CONNECTION WITH THE WIDENING OF BALBOA BOULEVARD WHEREAS, there has been delivered to the City of Newport Beach a certain grant deed dated May 15, 1972 , wherein THOMAS C. ROGERSgrants to the City of Newport Beach the following described real property in connection with the widening of Balboa Boulevard: and That portion of Lot 8 in Block 145 of Canal Section as shown on a map recorded in Book 4 page 98 of Miscellaneous Maps, Records of Orange County, California, and that portion of Section 29 Township 6 South, Range 10 West in the San Bernardino Meridian, according to the official plat of said land filed in the District Land Office August 4, 1890, all in the City of Newport Beach, County of Orange, State of California described as follows: Beginning at a point in the easterly line of said Lot 8 distant thereon North 10 °39130" East 17.43 feet from the southeasterly corner thereof; and running thence North 10 °39 330`° East along the easterly line and its northeasterly prolongation to its intersection with the line of ordinary high tide of the Pacific Ocean in Newport Bay, as described in the decree recorded September 19, 1928 in Book 201 page 253, Official Records, and designated therein "South Line ", thence North 74 °15321" West along said south line 80.30 feet to the true point of beginning; thence South 10° 39130" West parallel with the easterly line of said Lot 8, 94.78 feet to the southwesterly line of the land conveyed to Jacton Corporation, by deed recorded October 25, 1956 in Book 3689 page 556, Official Records; thence North 37 °13130" West along said southwesterly line 50.38 feet to the beginning of a tangent curve concave northeasterly and having a radius of 727 feet; thence northwesterly along said curve, through a central angle of 7 °43324 ", an arc distance of 98.90 feet to said south line of the ordinary high tide; thence south 74 015 321" East along said south line, 105.90 feet to the true point of beginning. EXCEPTING therefrom the southerly 25 feet of said land, said southerly 25 feet being measured at right angles to the northeasterly line of Balboa Boulevard, all oil, gas and other hydrocarbon substances and materials of whatsoever nature in, on or under that may be produced from said real property, but not reserving unto the grantor the right of surface entry, as reserved in the deed from the City of Newport Beach to Jacton Corporation, dated October 8, 1956, and recorded October 25, 1956 in Book 3689, page 556, Official Records; -1- WHEREAS, it is to the interest of the City to accept said grant deed; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said grant deed is hereby accepted, and the City Clerk is authorized and directed to execute and attach thereto a certificate of acceptance and consent to its recording and to cause said document to be recorded in the Orange County Recorder's Office.
