TITLE: APPOINTMENT TO THE BALBOA VILLAGE ADVISORY
COMMITTEE (BVAC)
ABSTRACT:
At the October 23, 2012 City Council meeting, appointments were made to the Balboa
Village Advisory Committee ( "BVAC "). At that meeting, then Mayor Gardner appointed
then Mayor Pro Tem Curry as the City Council representative to BVAC. Mayor Curry
desires to remove himself from BVAC and appoint Council Member Petros in his place.
RECOMMENDATION:
Confirm the Mayor's appointment of Council Member Tony Petros to assume Mayor
Curry's position on BVAC.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
At the Regular Meeting of September 25, 2012, the City Council created the Balboa
Village Advisory Committee (Resolution No. 2012 -85). The City Council confirmed
Council Member Henn's appointment to the BVAC on September 25. On
October 23, 2012, Mayor Gardner appointed Mayor Pro Tern Curry to BVAC; however,
it is the desire of Mayor Curry to have Council Member Petros assume his position on
BVAC.

BVAC consists of two Council Members, a member from the Balboa Village Business
Improvement District Board, an ExplorOcean Representative, a member from the
Balboa Peninsula Point Homeowners Association, a member from the Central Newport
Beach Community Association, and one At -Large representative. The remainder of the
BVAC seats were filled at the October 23, 2012 City Council meeting.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
