Alford, Planning Manager APPROVED: P-� 01 IniMion of an Arfiendment to the Zoning Code to Modify the TITLE: Minimum Lot Area /Density Standard for Mixed -Use Zoning Districts ABSTRACT: Staff is requesting the City Council initiate a code amendment to modify the minimum lot area /density standard for mixed -use zoning districts. RECOMMENDATION: Initiate an amendment to Chapter 20.22 (Mixed -Use Districts) of the Zoning Code. FUNDING REQUIREMENTS: The adopted Fiscal Year 2012 -13 budget includes sufficient funding for this amendment; staff estimates that approximately 20 -40 hours will be spent on this effort plus the cost of noticing and publishing materials for public hearings. DISCUSSION: The update of the General Plan in 2006 included several new mixed -use land use categories. Most of these mixed -use land use categories included a minimum residential density, which was intended to provide a sufficient population to support a viable mixed -use community. This policy was implemented in the Zoning Code by establishing a minimum residential density development standard for each of the mixed - use zoning districts. Staff has reviewed a number of proposed mixed -use projects that are unable to meet the minimum residential density development standard, and therefore, these projects are unable to be considered further. This problem occurs mainly on smaller parcels that 1 Initiation of an amendment to the Zoning Code February 12, 2013 Page 2 cannot accommodate off - street parking for both the minimum number of residential units and the minimum amount of non - residential floor area. Therefore, staff is recommending that the Council consider an amendment that modifies the minimum number of residential units that are required in mixed -use zoning districts. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
