Webb, Public Works Director 949 - 644 -3311, dawebb @newportbeachca.gov PREPARED BY: Michael Sinacori, Assistant City Engineer 949- 644 -3342, msinacori @newportbeachca.gov APPROVED: TITLE: Reimbursement to Ridgeway Development Company for Reconstruction of a City Sewer Main ABSTRACT: Ridgeway Development Company (Developer) is requesting reimbursement for a portion of the total cost to reconstruct the City sewer main as part of the Mariner's Pointe Development. RECOMMENDATION: Approve payment in the amount of $21,362.15 from the sewer fund to Ridgeway Development Company for reimbursement of a portion of the cost to reconstruct an existing City sewer main adjacent to the Mariners Pointe development which was beyond the required scope of the development project's requirements. FUNDING REQUIREMENTS: Funding is available in the FY 12 -13 CIP budget for Sewer Pipeline Point Repairs and Lining (Account 7541- C7001002) to fund the reimbursement amount of $ 21,362.15. DISCUSSION: As part of the Mariner's Pointe Development, an existing 8 -inch City sewer main running through the proposed developer's property was initially planned to remain in place (see Attachment B). Unrelated to the development, the City's Sewer Master Plan identified a portion of a City sewer main immediately behind the development that serves homes on Kings Road was in need of replacement. The developer worked cooperatively with City staff to reroute the existing sewer that was to remain, into a new sewer main that was constructed by the developer along the back of the project and into Dover Drive in lieu I of 6 Reimbursement to Ridgeway Development Company for Reconstruction of a City Sewer Main March 12, 2013 Page 2 of replacing the existing sewer running through the project. This new sewer now also serves as the replacement sewer line serving the properties above on Kings Road as identified in the City Sewer Master Plan. To construct this new City sewer main, the developer was required to coordinate with private property owners above his project to obtain the necessary sewer easements, as well as prepare all necessary construction drawings and install the new sewer main at no cost to the City. During construction of this new sewer main, it was discovered that the existing City sewer main located in Dover Drive was in sub - standard condition and in need of repair. As the new sewer main behind the developer's property was being installed, replacement of the sub - standard sewer in Dover Drive was necessary to properly connect the new sewer being constructed by the developer to the existing City sewer in Dover Drive. The developer with concurrence from the City moved forward with the replacement work in Dover Drive and requested reimbursement for those costs. The developer submitted a letter and breakdown of the costs involved in relocating and replacing the City sewer main totaling $113,687.35 (Attachment C). Staff believes it would be fair to reimburse the developer the amount of $21,362.15 for that portion of the sewer repair efforts that directly benefited, and would otherwise be the responsibility of the City. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15301 (Existing Facilities Class 1) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). The original concept that was discussed during the processing of the Mariner's Pointe project was to provide a race -wqy on the project site that would have been substantially less expensive than the build alternative. However, in the spirit of cooperation we designed and rebuilt the plain line. Attached for your review is the additional cost associated with the construction of the work to relocate the city sewer line off of Kings Road. Not included in the surn4nary are civil cost, legal cost, neighbor financial cost and city permit fee costs. Collectively-those costs are in excess of $30,000. The purpose of this letter is to seek reimbursement for those cost that directly benefit the city. The total cost is $19,598.30. To be added to this is another $1 ,763.85 -for overhead and profit to the contractor. The total requested reimbursement would be $21,362.15. While I do not feel it would be unreasonable to request the majority of the attached summary, since this work rebuilt the city's main sewer line, we have limited our request to the above.
