Komen - Race for the Cure' Banners - Approval of Encroachment Permit N2013 -0212 ABSTRACT: "Susan G. Komen - Race for the Cure" is requesting approval to install 89 banners on City owned streetlights along various roadways within the City and Caltrans rights -of- way for the 22nd annual 'Race for the Cure" event. RECOMMENDATION: Conditionally approve the request of "Susan G. Komen — Race for the Cure' for installation of 89 banners, from Monday, August 26, 2013, to Monday, September 23, 2013, for the annual `Race for the Cure' event. Installation will be along Westcliff Drive, Jamboree Road, East Coast Highway and MacArthur Boulevard. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The Orange County Affiliate of "Susan G. Komen - Race for the Cure' has requested that 89 private banners be installed from August 26 through September 23, 2013, along the City's major thoroughfares, for the 22nd annual Race for the Cure. The banners will be mounted on streetlight poles in the public right -of -way along Westcliff Drive (4 banners), Jamboree Road (21 banners), East Coast Highway (49 banners) and' MacArthur Boulevard (15 banners). See attached Location Map. The banners on portions of East Coast Highway are within Caltrans right -of -way and will require a 1 of 11 "Susan G. The applicant requests to relocate six (6) banners from East Coast Highway between Jamboree Road and MacArthur Boulevard to East Coast Highway between MacArthur Boulevard and Goldenrod Avenue after the CdM Coastline Car Classic banners are removed, on or around Monday, September 9, 2013. On September 22, 2013, the Orange County Affiliate of "Susan G. Komen - Race for the Cure" will host the 22nd annual Race for the Cure, a 5k Run/Walk and 1 -Mile Fun Walk fundraiser supporting breast cancer research and education. In 2012, the applicant reports there was over 30,000 participants and volunteers and raised $2.4 million for the Newport Beach (Orange County) Race for the Cure. The run /walk route is around the Fashion Island area. The expo area is within the Pacific Life Insurance Company parking lot. The Newport Beach Marriott Resort and Spa is the official host hotel and reports hotel rooms sell out on the event weekend. Participants pay a nominal registration fee ranging from $25 to $35. The City Council has provided the applicant $10,000 in Special Event Support funding this year. The event is not co- sponsored by the City of Newport Beach and is not free to the public. "Susan G. Komen — Race for the Cure" is a Texas, charitable organization (non- profit) IRS 501(c)(3) corporation. Council Policy L -16 prohibits the use of a commercial sponsor's name on banners. However, the event will be community -wide, open to the public, and may generate additional revenue to the City through restaurants, businesses, and hotel reservations. This is the 2nd time "Susan G. Komen — Race for the Cure" has requested street light banners for the event. In the past, requests for similar events (Taste of Newport, BCS Championship, and Barrett- Jackson Car Auction Company) have been approved by City Council and there have been no reported public complaints. Should the City Council elect to approve the installation of 89 private banners in the City for 30 days, staff recommends the following conditions of approval: 1. No banners shall be installed on traffic signal poles or metal streetlight poles. 2. The applicant must provide on -going maintenance of the banners and brackets. 3. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the banners /brackets and indemnification and hold harmless for any liability associated with the banners /brackets. 4. The applicant must maintain a minimum of $1,000,000 in liability insurance from a company with a Best's Key Rating Guide parameter of "A" or better, and a 2 of 11 "Susan G. The applicant will obtain an Encroachment Permit (N2013 -0212) from the Public Works Department. 6. The banners shall conform to City Council Policy L -16 with the exception of open to the public free of charge and co- sponsor by the City. 7. All banners and brackets shall be removed by the end of the approved time. 8. All banners and brackets shall comply with the Encroachment Permit conditions. 9. If needed, the City may require removal of some of the banners to allow other organizations to install banners at the same location and during the same time period. 10. A minimum of two 5 -inch wide half - circle wind slits per banner are required to minimize the wind load. 11. A Caltrans Standard Encroachment Permit shall be obtained for the banners within Caltrans right -of -way. It should be noted that Council Policy L -16 was amended on May 14, 2013 and if this request is approved, subsequent requests for the same event may be approved by the City Manager, provided that the size, number, location, and banner type (language and graphics) are unchanged. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). 3 of 11 "Susan G.
