A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CONFIRMING THE ASSESSMENT AND
DIAGRAM MADE AND FILED BY THE SUPERINTENDENT
OF STREETS OF SAID CITY ON THE 8th DAY OF MARCH,
1973, AS SAID ASSESSMENT WAS ORDERED CORRECTED
AND MODIFIED BY SAID CITY COUNCIL AFTER A PUBLIC
HEARING HELD ON THE 23rd DAY OF APRIL 1973, TO
COVER THE SUMS DUE FOR THE WORK AND IMPROVEMENT
OF CERTAIN STREET AND ALLEY IMPROVEMENTS IN
• "ASSESSMENT DISTRICT NO. 54" AS CONTEMPLATED BY
RESOLUTION OF INTENTION NO. 7575 OF SAID CITY
AND RESOLUTION OF INTENTION NO. 7717 OF SAID
CITY; AND ORDERING THE SUPERINTENDENT OF STREETS
TO ATTACH A WARRANT TO SAID ASSESSMENT AS COR-
RECTED AND MODIFIED
WHEREAS, the Superintendent of Streets of the City
of Newport Beach did on the 8th day of March 1973 file with the
City Clerk of said City his assessment and diagrem to cover the
sums due for the work of construction of certain street and alley
improvements and appurtenant work in "Assessment District No. 54"
in said City, as said work is described in Resolution of Inten-
tion No. 7575 and in Resolution of Intention No. 7717; and
WHEREAS, the City Clerk of said City gave notice in the
manner required by law of said assessment, that Monday, the 26th
day of March, 1973, all persons interested in the work done or
in the assessment would have an opportunity to be heard by the
City Council; and
WHEREAS, said public hearing was continued from March
26, 1973 to April 23, 1973 and
WHEREAS, the City Council has now considered said
assessment and diagram as filed as well as the testimony of those
interested in the work done or in the assessment.
NOW, THEREFORE, the City Council of the City of Newport
Beach DOES HEREBY DETERMINE, ORDER AND RESOLVE as follows:
SECTION .:I. That said assessment be corrected and
modified as determined at the close of the public hearing held
on the 23rd day of April, 1973;
• SECTION 2. That said assessment as corrected and said
diagram be and the same is hereby confirmed and approved;
SECTION 3. That this City Council does hereby find
and determine that the amounts so fixed herein as the amount of
assessment is the proportionate benefit received by said lot of
land as to which said assessment is affixed;
SECTION 4. That the work of construction of the
street and alley improvements and appurtenant work in "Assess-
ment District No. 54" is hereby accepted and the City Clerk is
authorized to file and record a Notice of Completion. The
City Clerk is further authorized to release the bonds 35 days
after the Notice of Completion has been recorded;
• SECTION 5. That a contribution by the City of Newport
Beach to "Assessment District No. 54" in the total amount of
$80,270.30, to be paid $34,818.28 in cash, and a credit of
$45,451.77 for incidental expenses is hereby approved;
SECTION 6. That the Superintendent of Streets shall
forthwith attach a warrant to said assessment bearing the date
of this order of the City Council;
SECTION 7. The City Clerk shall certify to this Resolu-
tion and a certified copy thereof shall be attached to the assess-
ment.
ADOPTED this 23rd day of April, 1973.
