A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING THE ANNEXATION TO
THE CITY OF CERTAIN UNINHABITED TERRITORY
CONTIGUOUS TO THE CITY OF NEWPORT BEACH AND
• KNOWN AS ANNEXATION NO, 79, SUPERIOR AVENUE/
HOSPITAL ROAD, NO. 2
WHEREAS, on November 14, 1973, the Local Agency
Formation Commission of Orange County approved the proposed
annexation to the City of Newport Beach of that certain
territory as hereinafter described, designated as Annexation
No. 79, Superior Avenue /Hospital Road, No. 2, pursuant to the
application filed by Mariners Savings and Loan Association on
behalf of William Cagney, the sole owner of the territory to
be annexed; and
WHEREAS, on November 14, 1973, the Local Agency
Formation Commission of Orange County approved the request
of the City of Newport Beach requesting that the City Council
be authorised to annex said territory without notice and
hearing pursuant to Section 54797.1 of the Government Code,
after proof having been submitted to said Commission that all
of the owners of the land within the territory proposed to be
annexed had given their written consent to such annexation; and
WHEREAS, it appears that the necessary proceedings in
accordance with the requirements of the Annexation of Uninhabited
Territory Act of 1939 have been completed;
NOW, THEREFORE, the City Council of the City of
Newport Beach HEREBY RESOLVES as follows:
Section 1: The annexation to the City of Newport
Beach, California of that certain uninhabited territory
contiguous to said City, known as Annexation No. 79, Superior
isAvenue /Hospital Road, No. 2, is hereby approved; said property
is more particularly described as follows:
That portion of Lot 172 in Block 1 of Irvine's
Subdivision, as shown on a map thereof recorded in Book 1,
page 88 of Miscellaneous Record Maps, records of Orange
County, California, described as follows:

BEGINNING at the northeasterly terminus of that
certain course in the existing boundary line of the City
of Newport Beach as established by the "Superior Avenue -
Hospital Road Annexation No. 74 ", described therein as
having a bearing and distance of "North 39 041115" East,
314.29 feet ", said northeasterly terminus being also the
most westerly corner of Parcel 2 as shown on a map filed
in Book 1, page 35 of Parcel Maps, records of said Orange
County; thence along said exi -king boundary line, being
also the southerly line of said Parcel 2, South 89 045135"
East, 470.86 feet to the most southerly corner of Lot B
as shown on a map filed in Book 9, page 19 of Parcel Maps,
records of said Orange County, being also an angle point
in the existing boundary line of the City of Newport Beach,
as described in Annexation No. 58 to the City of Newport
Beach; thence along the boundary of said Annexation No. 58,
being also the southwesterly line of said Lot B, North
50 °00'19" West, 362.00 feet to the most westerly corner
of said Lot B, being also an angle point in the boundary
of said Annexation No. 58, and being also a point in the
centerline of Superior Avenue as shown on said map filed
in Book 1, page 35 of Parcel Maps; thence leaving said
existing boundary line and along said centerline of
Superior Avenue, being also the northwesterly line of said
Parcel 2, South 39 °59141" West, 301.12 feet to the POINT
OF BEGINNING.
Section 2: The above parcel of property legally
described in Section 1 shall be subjected to taxation after
annexation equally with property within the City of Newport
Beach to pay any indebtedness and liabilities of the City of
Newport Beach outstanding, contracted, authorized, or existing
prior to, or at the time of annexation.
Section 3: The boundaries of the City of Newport
Beach, California, shall be, and the same are hereby altered
to include the territory described in Section 1 of this
Resolution.
Section 4: The City Clerk is hereby directed to file
a certified copy of this Resolution with the Secretary of
State.
ADOPTED this 10th day of December, 1973.
