AYES: Ameri, Brown, Kramer, Lawler, Myers, and Tucker NOES: None ABSENT: Hillgren ABSTAIN: None PUBLIC HEARING ITEMS: ITEM NO. 2 216 CRYSTAL VARIANCE (PA2013 -118) Site Location: 216 Crystal Avenue SUMMARY: A request for a variance to allow the following improvements to an existing nonconforming duplex: 1) a second story addition which would exceed the maximum allowed floor area; 2) an addition greater than 10 percent of the existing square footage without providing the required number of parking spaces (two garage spaces per unit); and 3) encroachment into the 4 -foot side yard setback along E. Bay Front Alley. Assistant Planner Melinda Whelan gave a presentation summarizing the applicants' request. Vice Chair Tucker recused himself from considering the item on the basis that he owns property near the subject property. The Planning Commission approved the project as recommended (5 ayes, 1 recusal, 1 excused). City Council Staff Report September 24, 2013 Page 2 AYES: Ameri, Brown, Kramer, Lawler, and Myers NOES: None ABSENT: Hillgren ABSTAIN: None RECUSAL: Tucker STUDY SESSION: ITEM NO. 3 WIRELESS TELECOMMUNICATIONS FACILITIES ORDINANCE (PA2012 -057) Site Location: City -wide SUMMARY: An amendment to the Newport Beach Municipal Code ( "NBMC") to update regulations regarding wireless telecommunication facilities ( "Telecom Facilities'). Regulations currently contained in Chapter 15.70 would be updated and relocated to Title 20 (Planning and Zoning) and Chapter 15.70 would be rescinded in its entirety. Principal Planner Jim Campbell provided background on the process and an overview of the changes and remaining issues. The Commissioners reviewed the draft ordinance with input from representatives from telecommunication industry and public who were present. The Commission directed staff to return with a revised draft on October 17, 2013 for further discussion. No formal action was required. OTHER BUSINESS: ITEM NO. 4 LAND USE ELEMENT AMENDMENT (PA2013 -098) Site Location: City -wide SUMMARY: Review of land use amendments as recommended by the Land Use Element Amendment Advisory Committee. These recommended amendments will be included in the project description for the draft environmental impact report. Formal Planning Commission public hearings on the proposed amendments are anticipated to occur in the spring of 2014. Submitted by: Deputy Director Brenda Wisneski gave a presentation summarizing the land use changes under consideration by the Committee. Following discussion, the Planning Commission indicated their support for the direction the Committee was taking. No formal action was required. , Deputy Director
