HomeMy WebLinkAbout8606 - Closing Up- Vacation- Abandonment of Lafayette Alley• • • RESOLUTION NO. 8606 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING ITS IN- TENTION TO ORDER. THE CLOSING UP, VACATION AND ABANDONMENT OF AN ALLEY WESTERLY OF LAFAYETTE AVENUE BETWEEN 31ST STREET AND 32ND STREET AND SETTING A PUBLIC HEARING The City Council of the City of Newport Beach, pursuant to the provisions of the "Street Vacation Act of 1941 ", and all amendments thereto, being Sections 8300 to 8331, inclusive, of the Streets and Highways Code of the State of California, DOES HEREBY RESOLVE AND DECLARE as follows: SECTION 1. The public interest and convenience require the closing up and abandonment of an alley lying Westerly of Lafayette Avenue between 31st and 32nd Streets in the City of Newport Beach, and it is the intention of the City Council of the City of Newport Beach to order the following described portions of said alley in the City of Newport Beach, County of Orange, State of California, to be vacated, closed up and abandoned, to wit: A parcel of land being a portion of Lots 15, 16, 17, 18, 19, 20 and 21, and a portion of the alley (14 feet in width), in Block 530 of Lancaster's Addition as said tract is shown on a map recorded in Book 5, Page 14 of Miscellaneous Maps, Records of Orange County, California, more particularly described as follows: Beginning at the centerline intersection of Villa Way (30' in width) and the alley (14'in width) in Block 530 of the aforementioned Lancaster's Addition as each is shown on the aforementioned record map, thence North 89 °15'30" East a dis- tance of 240.00 feet along said centerline of said alley, thence North 0 044'30" West a dis- tance of 13.00 feet along the Southerly prolong- ation of the Westerly line of Lot 21 of said Block 530 to a point, said point being the TRUE POINT OF BEGINNING: thence Southeasterly a dis- tance of 23.05 feet along the arc of a tangent curve concave Southwesterly, said curve having a radius of 50.00 feet and a central angle of -1- 26 024'48 ", thence South 64 °19'42" East a dis- tance of 19.44 feet along a tangent line to a point of tangency with an arc, said arc being concave Northeasterly, having a radius of 30.00 feet and a central angle of 26 024'48 ", thence • Easterly along said arc a distance of 13.74 feet to a tangent line parallel with and 4.00 feet Southerly of said centerline of said alley, thence North 89 115'30" East along said parallel • line a distance of 95.80 feet to a point in a line parallel with and 36.00 feet measured at right angles, Northwesterly of the Northwesterly right -of -way line of Lafayette Avenue, being 40.00 feet in width as said right -of -way is shown on the aforementioned map of Lancaster's Addition, thence North 20 054130" East a distance of 29.05 feet along said parallel line to the point of intersection with said Southerly line of that cer- tain parcel of land as described in the Grant Deed recorded August 10, 1950 in Book 2054, Page 24 of Official Records of Orange County, said Southerly line being parallel with and 23.00 feet Northerly measured at right angles of the centerline of the aforementioned alley, thence South 89 015'30" West a distance of 159.52 feet along said parallel line to the point of intersection with the aforementioned Westerly line of Lot 21, thence South 0 044'15" East a distance of 10.00 feet along said Westerly line to a Point of Beginning. Reserving therefrom a public utility easement over that portion thereof lying Southerly of a line parallel with and 7.00 feet measured at right angles from.the centerline of said 14 foot alley. Those portions of said alley to be vacated, closed up and abandoned are more clearly shown on a certain map approved and adopted by the City Council, City of Newport Beach for said vacation, closing up and abandonment, by Resolution dated October 14 , 1975, and designated Resolution No. 8605 , which said map is on file in the office of the City Clerk, of the City of Newport Beach. Reference is hereby made to said map for further particulars as to the proposed vacation, closing up and abandonment of said portions of said alley, and said map is made a part of this Resolution by reference to the same extent and purpose as if it were incorporated herein in full. SECTION 2. The proceedings for the closing up and • abandonment of the aforesaid portions of said alley shall be had and taken, and the City Council of the City of Newport Beach -2- hereby elects to proceed under the provisions of the "Street line of the portions of said alley proposed to be vacated not more than 300 feet apart, but not ".less than three in all, notices of the vacation of said portions of said alley. Said notes shall state the passage of this resolution and the time and place of the hearing of all persons interested in or objecting to the proposed vacation of said alley. Said notices shall be posted not less than ten (10) days prior to the date of said hearing, as required by law. SECTION 4. There is hereby reserved and excepted from the vacation of said alley a permanent easement for public utility purposes as hereinbefore specifically described. These vacation proceedings are taken subject to the reservation and exception herein contained as to said alley. SECTION 5. Notice is hereby given that the City Council of the City of Newport Beach does hereby fix Mond 1975, at the hour of 7:30 P.M. of said day,in the of the City of Newport Beach, located in the City time and place for hearing all persons interested to the proposed vacation of said portions of said before described. iy, November 10, Council Chambers Hall, as the in or objecting alley herein- SECTION 6. Said notes shall state the passage of this resolution and the time and place of the hearing of all persons interested in or objecting to the proposed vacation of said alley.
