RESOLUTION NO. 8833
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE PARKS, BEACHES
• & RECREATION DIRECTOR TO ENTER INTO NEGOTIATIONS
WITH THE IRVINE COMPANY TO LEASE A PARCEL OF
LAND WITHIN THE CITY LIMITS FOR THE DEVELOPMENT
• OF A SKATEBOARD PARK
WHEREAS, The Irvine Company has offered to lease
several parcels of Irvine Company land located within the City
of Newport Beach to the City for the establishment of a
skateboard park; and
WHEREAS, the terms of said lease would extend for a
period of ten (10) years at a rate of eight percent (8 %) of the
appraised value of the subject property; and
WHEREAS, three developer- operator firms have expressed
an interest in constructing and operating a skateboard park on
one of the proposed Irvine Company sites; and
WHEREAS, the City Council believes it desirable to
authorize the staff to enter into negotiations to lease one of
the Irvine Company sites to be used as a skateboard park;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach hereby authorizes the Parks, Beaches
& Recreation Director to enter into negotiations with The Irvine
Company to lease a parcel of property located within the City
of Newport Beach to be used for the establishment of a skateboard
park;
BE IT FURTHER RESOLVED that the terms and conditions
isof said lease shall be for a period of ten (10) years at a rental
• rate of eight percent (8%) of the appraised value of the property
and that sufficient indemnity and bonding assurances be provided
for;

BE IT FURTHER RESOLVED that said lease agreement
shall be contingent upon the selection of a developer- operator
for the implementation of the skateboard park and that the City
receive sufficient income from the operation to cover and offset
all of the lease costs, as well as administrative overhead;
BE IT FURTHER RESOLVED that final approval of said
lease agreement and developer- operator proposal is subject to
review by the City Council.
