HomeMy WebLinkAbout9307 - Amendment 504RESOLUTION NO. 9307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTING AN AMENDMENT TO THE PLANNED COMMUNITY DEVELOPMENT STANDARDS FOR "NEWPORT PLACE" TO PERMIT THE PLANNING COMMISSION TO GRANT EXCEPTIONS TO THE MINIMUM • LOT SIZE REQUIREMENT OF THIRTY THOUSAND (30,000) SQUARE FEET IN THE PLANNED COMMUNITY, AND THE ACCEPTANCE OF AN ENVIRONMENTAL DOCUMENT (Amendment No. 504) WHEREAS, Section 20.51.045 of the Newport Beach Municipal Code provides that final amendments to a Planned Community Development Plan must be approved by a resolution of the City Council setting forth full particulars of the amendment; and WHEREAS, the Planning Commission conducted a public hearing on March 16, 1978, at which time it considered a certain amendment to the Planned Community Development Plan for "Newport Place "; and WHEREAS, at said public hearing the Planning Commission adopted Resolution No. 1003 recommending to the City Council that a certain amendment of the Planned Community Development Plan for "Newport Place" be adopted as follows: (A) Page 13 be amended to read: "PART I. INDUSTRIAL Section I. Minimum Site Area A. Thirty Thousand (30,000) square feet. B. Exception: (11) The Planning Commission may authorize an exception to the minimum site area. Application for any such exception shall be made at the time of the • filing of a tentative map by the applicant. In order for an exception to be granted, the Planning Commission shall find the following facts with respect thereto: -2- "1. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the vicinity. 2. That the development considerations • and intent of this Planned Community Development Standards are substantially met." (B) Page 27 be amended to read: "PART II: COMMERCIAL Section I. Minimum Site Area A. Thirty Thousand (30,000) square feet. B. Exception: (11) The Planning Commission may authorize an exception to the minimum site area. Application for any such exception shall be made at the time of the filing of a tentative map by the applicant. In order for an exception to be granted, the Planning Commission shall find the following facts with respect thereto: 1. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the vicinity. 2. That the development considerations and intent of this Planned Community Development Standards are substan- tially met." (C) Page 37, Footnote No. 11, be amended to read: "(11) Planned Community Text Amendment No. 11, dated April 10, 1978 incorporating the following change: a. Establish guidelines for an exception to the minimum site area." -2- L WHEREAS, the City Council finds and determines that said certain amendment to said Planned Community Development Plan for "Newport Place" as set forth above is desirable and necessary; and WHEREAS, the City Council has conducted a public hearing on the proposed amendment in accordance with all provisions of law; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves the proposed amendment to the Planned Community Development Plan for "Newport Place" as referred to hereinabove. BE IT FURTHER RESOLVED that the notice of exemption in connection herewith be accepted. ADOPTED THIS 10th day of April , 1978.
