A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING ITS INTENTION TO
ORDER THE VACATION AND ABANDONMENT OF A PORTION
OF EL CAPITAN DRIVE, AND SETTING May 8, 1978
AS THE DATE FOR THE PUBLIC HEARING CONCERNING
• THE INTENDED VACATION
The City Council of the City of Newport Beach under
the provisions of the "Public Service Easements Vacation Law"
and amendments thereto, section 50430 et seq. of the California
Government Code, does hereby resolve and declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of
Newport Beach to order the vacation and abandonment of a portion
of E1 Capitan Drive, which is more particularly described as
follows:
"That portion of E1 Capitan Drive as shown on Tract
7844 recorded in Book 314, pages 27 through 38
inclusive and Tract 7386 recorded in Book 315, pages
40 through 46 inclusive, both of Miscellaneous Maps,
Records of Orange County, California, and more
particularly described as follows:
Parcel 1
Beginning at the intersection of the centerlines
of Spy Glass Hill Road and E1 Capitan Drive as
shown on said Tract No. 7844; thence northerly
70.99 feet along said centerline of Spy Glass Hill
Road to the northerly boundary of said Tract
Number 7844; thence South 78 °20133" East 54.00
feet to the TRUE POINT OF BEGINNING; said point
being also the beginning of a non - tangent curve
concave northesterly and having a radius of 25.00
feet; thence southerly and southeasterly 37.99
feet along said curve through a central angle of
87 004110 "; thence South 75 024143" East 0.73 feet
to a point hereinafter referred to as Point "A ";
thence South 14 035117" West 16.00 feet to the
beginning of a non - tangent curve concave north-
easterly having a radius of 25.00 feet; thence
northwesterly and northerly 38.26 feet along said
curve through a central angle of 87 041142" to a
point on a reverse curve concave southwesterly
and having a radius of 1442.00 feet; thence
• northerly 15.74 feet along said curve through a
central angle of 1 037'32" to the TRUE POINT OF
BEGINNING.
Reserving from the vacation of said portion of said
street.an easement for public utility purposes.

"Parcel 2
A strip of land 16 feet in width, measured at
right angles, the northerly and easterly line
of said strip being the northerly and easterly
line of E1 Capitan Drive as shown on said
Tract Numbers 7844 and 7386 and described as
follows: .
Beginning at Point "A" as described in Parcel 1
above; thence South 75 024143" East 31.61 feet to
the beginning of a tangent curve concave northerly
and having a radius of 360.00 feet; thence
easterly 137.63 feet along said curve through a
central angle of 21 054'17 "; thence North 82 041'00"
East 283.14 feet to a curve concave southerly
having a radius of 1040.00 feet; thence easterly
599.44 feet along said curve through a central
angle of 33 °01129 "; thence South 64 017131" East
267.15 feet to a curve concave southerly having
a radius of 1050.00 feet; thence easterly 214.69
feet along said curve through a central angle of
11 042'54 "; thence South 52 034137" East 150.40
feet to a curve concave southwesterly having a
radius of 650.00 feet; thence southerly 479.25
feet along said curve through a central angle of
42 014'42 "; thence South 10 019155" East 729.18
feet to a curve concave westerly having a radius
of 850.00 feet; thence southerly 189.33 feet
along said curve through a central angle of
12 045'44 "; thence South 2 025'49" West 505.63
feet.
Reserving from the vacation of said portion of said
street an easement for public utility purposes."
Said portion of E1 Capitan Drive to be vacated and
abandoned is shown on a certain map entitled Exhibit '!C"
prepared by the City of Newport Beach Public Works Department
dated March 16, 1978, a copy of which is attached hereto,
marked Exhibit "A" and incorporated herein by this reference.
SECTION 2. The proceedings for the vacation and
abandonment of said portion of E1 Capitan Drive are taken pursuant
to, and the City Council of the City of Newport Beach elects to
proceed under the provisions of, the "Public Service Easement
Vacation Law" and-all amendments thereto, being sections 50430
and 50445, inclusive, of the California Government Code.
SECTION 3. The Public Works Director of the City of

Newport Beach shall cause to be conspicuously posted along the
portion of said property proposed to be vacated and abandoned,
not more than three hundred (300) feet apart,..and not less than
three (3) in all, notices of the vacation and abandonment of
said property. The notices shall state the passage of this
Resolution of Intention and the time and place of the hearing
before the City Council of all persons interested in or objecting
to the proposed vacation and.abandonment. Said notice shall be
posted at least ten (10) days before the date of said hearing.
SECTION 4. Notice is hereby given that the City Council
of the City of Newport Beach does hereby fix Monday, the 8th_
day of May , 1978, at the hour of 7:30 p.m. on said day
in the Council Chambers located in the City Hall of the City of
Newport Beach at 3300 Newport Boulevard, Newport Beach, California,
as the time and place for hearing all persons interested in or
objected to the proposed vacation and abandonment of said portion
of E1 Capitan Drive.
SECTION 5. A notice of the hearing hereinabove set,
giving the date, time and place of said hearing, shall be
published by the City Clerk in the official newspaper of the
City once each week for at least two (2) successive weeks prior
to said hearing.
