RESOLUTION NO. 9384
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH EXCEPTING CERTAIN
PROJECTS FROM CHAPTER 15.40 OF THE
NEWPORT BEACH MUNICIPAL CODE
WHEREAS, the City Council has adopted Ordinance
No. 1765 adding Chapter 15.40 to the Newport Beach Municipal
Code, entitled "Traffic Phasing Ordinance;" and
WHEREAS, Section 15.40.030(D) of said Chapter sets
forth conditions for granting exceptions from the Ordinance
based on certain findings.
NOW, THEREFORE, BE IT RESOLVED that pursuant to
Section 15.40.030(D)(i) of the Newport Beach Municipal Code,
the City Council of the City of Newport Beach does hereby
find that the following projects are excepted from the
Traffic Phasing Ordinance on the grounds that the City has
issued building or grading permits for the projects prior
to the effective date of Ordinance No. 1765, and that the
persons to whom such permits were issued have in good faith
and in reliance upon such permits diligently commenced
construction and incurred substantial liabilities for work
and materials:
1. Koll Center Newport;
2. EMKAY Newport Place;
3. North Ford Planned Community;
4. Corporate Plaza Planned Community;
5. Harbor View Hills Planned Community;
6. Versailles;

7. Jasmine Creek;
8. Gilbert Property;
9. Newport Terrace Phase II;
10. Grading Permit 3700 Campus Drive;
Building Permit 3700 Campus Drive.
ADOPTED this 26th day of June , 1978.
