HomeMy WebLinkAbout9411 - General Plan Amendments 78-1B & 78-1CRESOLUTION NO. 9411 A RESOLUTION OF THE CITY COUNCIL OF THE CITY • OF NEWPORT BEACH ACCEPTING THE NEGATIVE DECLARATION AND APPROVING AMENDMENTS TO THE LAND USE, RESIDENTIAL GROWTH AND CIRCULATION ELEMENTS OF THE NEWPORT BEACH GENERAL PLAN (AMENDMENT NOS. 78 -1 -B and 78 -1 -C) WHEREAS, Section 707 of the Charter of the City of Newport Beach provides that the City Council, upon recommendation by the Planning Commission, may amend the General Plan, or any part thereof; and WHEREAS, the General Plan of the City of Newport Beach contains the Land Use, Residential Growth and Circulation Elements which will serve as a guide for the future planning and development of the City; and WHEREAS, the Planning Commission has held a public hearing at which time it considered certain amendments to the Land Use, Residential Growth and Circulation Elements and adopted Resolution No. 1012, recommending to the City Council certain changes in said elements; and WHEREAS, the City Council finds and determines that the proposed amendments will not have a significant effect on the environment and desires to accept a Negative Delcaration prepared for said General Plan Amendment, NOW, THEREFORE, BE IT RESOLVED that the City Council hereby accepts the Negative Declaration on General Plan Amend- ment Nos. 78 -1 -B and 78 -1 -C. BE IT FURTHER RESOLVED that the following described amendments to the General Plan be adopted as follows: • 78 -1 -B: An amendment to the Land Use and Residential Growth Elements to designate a 2.3 acre parcel, adjacent to the Newport Terrace development (former City Dump site) and currently in the City of Costa Mesa, for "medium- density residential," setting a maximum number of dwellings on the site at twelve dwelling units, and in favor of annexation of the subject property to the City of Newport • Beach. 78 -1 -C: An amendment to the Land Use, Residential Growth and Circulation Elements as follows: 1. A revision in the text of the Land Use and Residential Growth Elements to prohibit resub- divisions in the Cliff Haven area which would result in lots smaller than the average or typical lot in that area, to be added at Page 21 of the Residential Growth Element as follows: "5) In all residential zones in the Cliff Haven area, any resubdivision which would result in lots smaller than the average or typical lot shall be prohibited, so as to preserve the scale and character of resi- dential development in that neighborhood. The zoning shall be amended accordingly." 2. Amend the Master Plan of Streets and Highway to incorporate housekeeping revisions pertaining to Coast Highway, Superior Avenue, and Balboa Boulevard in the West Newport area, which are as follows: (a) Show the proposed realignment of Superior Avenue at the intersection with Coast Highway on the Master Plan of Streets and Highways. (b) Amend the Master Plan to show the exten- sion of Balboa Boulevard north of Coast Highway shifted to a more westerly alignment. • (c) Page 6. of the Circulation Element, paragraph 2, to be amended to read as follows: "2. Coast Highway between Santa Ana River and Newport Boulevard. The future 24 -foot minimum widening of Coast Highway between the Santa Ana River and 59th Street will be on the -2- • • southerly side; and from 59th Street to Newport Boulevard, the widening will be on the northerly side. Additional widening beyond the 24 -foot minimum will be required at intersections to provide for turning lanes." (d) Delete the proposed alignment of Coast Highway northerly of Newport Shores from the Master Plan of Streets and Highways. BE IT FURTHER RESOLVED that no action be taken on proposed General Plan Amendment 78 -1 -A and those portions of General Plan Amendment 78 -1 -C which deal with the General Plan review of the large undeveloped sites within the City of Newport Beach which are dependent on the results of the traffic model. Further, no further consideration will be given to the proposed down zoning of the Newport Heights R -2 District. ADOPTED this 14th ATTEST: City Clerk 4C-RIW-12 S THE CMIGIIdA!
