RESOLUTION NO. 9413
A RESOLUTION OF THE CITY COUNCIL OF THE
• CITY OF NEWPORT BEACH, CALIFORNIA,
REQUESTING THE BOARD OF SUPERVISORS OF
THE COUNTY OF ORANGE TO CONSOLIDATE A
SPECIAL MUNICIPAL ELECTION OF THE CITY OF
NEWPORT BEACH WITH THE STATEWIDE GENERAL
ELECTION PURSUANT TO SECTION 23302 OF THE
ELECTIONS CODE
WHEREAS, the City Council of the City of Newport
Beach has called a special municipal election in the City
of Newport Beach to be held on November 7, 1978, for the
• purpose of submitting to the qualified voters of said City
an ordinance requiring dedication of streets in subdivisions
on bluffs adjoining Newport Bay or the Pacific Ocean; and
WHEREAS, it is desirable that said special municipal
election be consolidated with the statewide election to be
held on the same date and that within the City of Newport
Beach the precincts, polling places and election officers of
the two elections be the same, and that the Registrar of Voters
of the County of Orange canvass the returns of the special
municipal election and that said statewide election and
• special municipal election be held in all respects as if there
were only one election;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. That pursuant to the
requirements of

Code, the Board
of Supervisors
of the County of Orange be and
it hereby is
requested to consent
and agree to the consolidation
of a special
municipal election

with the statewide election on

1978, for the purpose of submitting to qualified voters of said
City an ordinance requiring dedication of streets in subdivisions
on bluffs adjoining Newport Bay or the Pacific Ocean.
SECTION 2. That on the ballots to be used at said
special election, in addition to any other matters required by
law, there shall be printed substantially the following:

STREETS IN SUBDIVISION(S) ON BLUFF(S) ADJOIN-

ordinance containing a general requirement that
whenever any subdivision of previously unsub-
divided land is situated on a bluff that adjoins
Newport Bay and /or the Pacific Ocean, there shall
be a public'street dedicated (including all
access streets thereto) to be located between the
development and not less than 25 feet from the

edge of undiminished bluff with local park dedi-
cation requirements applied to that area?
SECTION 3. The Registrar of Voters is hereby authorized
to canvass the.retuYns of said special municipal election which
it is hereby requested to consolidate with said statewide election
and said election shall be held in all respects as if there were
only one election and only one form of ballot shall be used.
SECTION 4. Said Board of Supervisors is hereby
requested to issue instructions to the Registrar of Voters to
take any and all steps necessary for the holding of said con-
solidated election.
SECTION 5. The City of Newport Beach recognizes that
additional costs will be incurred by the County by reason of
this consolidation and agrees to reimburse the County for any
such costs.
SECTION 6. That the City Clerk of the City of Newport
Beach is hereby directed to file a certified copy of this resolu-
