A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF NEWPORT BEACH DECLARING THE RESULTS OF THE
SPECIAL ELECTION HELD IN SAID CITY ON
NOVEMBER 7, 1978
The City Council of the City of Newport Beach
DOES RESOLVE as follows:
SECTION 1. That the City Council does hereby find,
determine, and declare as follows:
a. That pursuant to applicable law, a special
election was held and conducted in said City on the
7th day of November, 1978; and
b. That said election was held and conducted in
conformity with all applicable provisions of law; and
C. That said special election was held for the
purpose of submitting to the voters of said City the
following measure, to wit:
Shall the City of Newport Beach adopt an
ordinance submitted as an initiative
measure entitled AN ORDINANCE REQUIRING
DEDICATION OF STREETS IN SUBDIVISIONS)
ON BLUFF(S) ADJOINING NEWPORT BAY AND/
OR PACIFIC OCEAN; said ordinance containing
a general requirement that whenever any
subdivision of previously unsubdivided
land is situated on a bluff that adjoints
Newport Bay and /or the Pacific Ocean,
there shall be a public street dedicated
(including all access streets thereto) to
be located between the development and not
less than 25 feet from the edge of
undiminished bluff with local park dedica-
tion requirements applying to that area?
d. That pursuant to direction of the City Council
• the Registrar of Voters has heretofore conducted a
canvass of the results thereof and has filed with said
City Council a certificate relating thereto which has
been examined and is hereby accepted by this City
Council.
SECTION 2. That the Statement of Election Results
relating to said special election is attached hereto as
Exhibit "A" and by this reference incorporated herein.
• SECTION 3. That the City Council does hereby accept
the canvass of record of said special election as certified
by said Registrar of Voters and does hereby declare that
Measure "N" - Iniative Measure re Dedication of Streets Along
Blufftops in New Subdivisions is hereby declared to have failed.
SECTION 4. That the City Council is hereby directed
to enter this resolution in full in the minutes of this City
Council, which entry shall constitute the City Clerk's statement
of the result of the election.
SECTION 5. That the City Clerk shall certify the
adoption of this resolution.
