HomeMy WebLinkAbout9486 - Underground Utilities District 6RESOLUTION NO. 9486 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING THE BOUNDARIES OF EXISTING UNDERGROUND UTILITIES DISTRICT NO. 6 TO INCLUDE DOVER DRIVE FROM THE COAST HIGHWAY NORTHERLY TO CLIFF DRIVE, AND TWO SMALL PARCELS ALONG THE COAST HIGHWAY WEST OF DOVER DRIVE WHEREAS, Chapter 15.32 of the Newport Beach Municipal Code, entitled "Underground Utilities," authorizes the City Council to hold public hearings to ascertain whether the public health, safety or welfare require the removal of poles, overhead wires and associated overhead structures within designated areas of the City, and underground installations of wires and facilities for supplying electric, communication, or similar services; and WHEREAS, on the 8th day of November, 1976, the City Council held a public hearing for the purpose of determining whether an underground utility district should be established within that certain territory referred to as Underground Utility District No. 6, which district was described by Resolution No. 8924; and WHEREAS, the City Council ordered the formation of Underground Utility District No. 6 on November 8, 1976, by the adoption of Resolution No. 8924; and WHEREAS, the City Council on November 27, 1978, set a public hearing to be held on December 20, 1978, at 7:30 p.m. for the purpose of determining whether Underground Utility District No. 6 should be amended by extending the boundaries to include Dover Drive from the Coast Highway northerly to Cliff Drive, and two small parcels along the Coast Highway west od Dover Drive; and WHEREAS, notices have been sent to all property owners within the territory proposed to be annexed to said Underground Utility District No. 6 and notice has been posted and published in the manner set forth in Chapter 15.32 of • the Newport Beach Municipal Code; and WHEREAS, after consideration of all protest to the annexation of said territory to Underground Utility District No. 6, the City Council has determined that public health, safety, and welfare require the amendment to said District by annexing thereto the territory described hereinafter, NOW, THEREFORE, the City Council hereby FINDS, DETERMINES AND ORDERS: SECTION 1. The public convenience, necessity, health, safety and welfare require the amendment to Underground Utility District No. 6 by annexing thereto certain territory located on Dover Dirve from the Coast Highway northerly to Cliff Drive, and two small parcels along the Coast Highway west of Dover Drive, the resulting amended Utility District No. 6, is described as follows: Those three portions of land in the City of Newport Beach, County of Orange, State of California, described as follows: Parcel A: Beginning at the intersection of the center line of Bay Shore Drive (55 feet in width) with the center line of Coast Highway (100 feet in width, shown as State Highway ORA -60B on map of Tract 1014 recorded in Book 33, page 31 of Miscellaneous Maps, Records of said County); thence westerly along said center line of Coast Highway to the notherly prolongation of the westerly line of Lot 72 of said Tract 1014; thence southerly thereon to the southerly line of said Coast Highway; thence easterly thereon to said center line of Bay .Shore Drive; thence northerly thereon to the point of beginning. Parcel B: Beginning at the southwesterly corner of Lot 2, Tract 1210 as per map recorded in Book 40, Page 12 of said Miscellaneous Maps, Records of said County; -2- thence southerly along the southerly prolonga- tion of the westerly line of said Lot 2 to the center line of said Coast Highway (100 feet in width); thence westerly along said last mentioned center line to the southerly prolongation of the westerly line of Lot 4, said Tract 1210; thence northerly thereon to the southwesterly corner of said Lot 4; thence easterly along the northerly line of said Coast Highway to the point of beginning. Parcel Cu Beginning at the northeasterly corner of Lot 1, said Tract 1210; thence northerly along the westerly line of Dover Drive as shown on a map recorded in Book 5905, Page 279 of Official Records of said County, and following the same through all of its various curves and courses to its intersection with a line that is parallel with and distant northerly 130 feet (measured at right angles) from the center line of Cliff Drive (80 feet in width) as per map of Tract 1219 recorded in Book 38, Page 27 of Miscellaneous Maps, Records of said County; thence easterly along said parallel line to the easterly line of said Dover Drive; thence southerly thereon and following the same through all of its various curves and courses to a line that is parallel with and distant northerly 250 feet (measured at right angles) from the center line of said Coast Highway; thence westerly along said last mentioned parallel line to the center line of Dover Drive (shown as 17th Street, 80 feet in width on said map of Tract 1210); thence south- erly along said last mentioned center line through a curve that is concave easterly to the easterly prolongation of the northerly line of said Tract 1210; thence westerly thereon in a direct line to the point of beginning. SECTION 2. The public necessity, health, safety, and welfare require the removal of poles, overhead wires, and associates overhead structures used to supply electric, communication and other similar services in their installation underground within the area heretofore described. SECTION 3. The City Council further finds that: A. The streets on which the work is to be performed are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic; and • B. The streets adjoin or pass through a public recreation area and an area of unusual scenic interest to the general public. SECTION 4. The above described area is hereby declared to be an underground utility district, to be known as Underground Utility District No. 6, and the affected -3- utility companies and property owners are ordered to cause the required removal and underground installation work to be done. SECTION 5. The date by which the required removal and underground installation work is to be accomplished and by which the affected property owners must be ready to receive underground service is December 31, 1980. SECTION 6. The City Clerk is directed to notify all affected utility companies and all persons owning property within said district of the adoption of this Resolution within ten (10) days after its effective date, in accordance with Section 15.32.080 of the Newport Beach Municipal Code.
