RESOLUTION NO. 9723
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO CONSENT TO AN AMENDMENT TO THE
DECLARATION OF COVENANTS, CONDITIONS AND'
RESTRICTIONS FOR TRACT NO. 5463 AND TRACT NO.
5480 IN THE BLUFFS LIMITING THE INCREASES IN
THE ANNUAL ASSESSMENTS
WHEREAS, on March 9, 1964, the City Council of the
City of Newport Beach adopted Resolution No. 5925 which
authorized the execution of the Declaration of Covenants,
Conditions and Restrictions for Tract No. 5463 and Tract
No. 5480, The Bluffs Homeowners' Community Association; and
WHEREAS, said Declaration of Covenants, Conditions
and Restrictions requires City Council approval of amendments
thereto; and
WHEREAS, on March 26, 1979, the City Council con-
sidered an amendment to the Declaration of Covenants, Condi-
tions and Restrictions for The Bluffs as requested by The
Bluffs Homeowners' Community Association, which consideration
was continued at the request of The Bluffs Homeowners' Commu-
nity Association; and
WHEREAS, on March 22, 1979, the homeowners of The
Bluffs Homeowners' Community Association voted favorably to
amend Article II, Section 6, of the Association By -Laws
regarding a limitation on increases in the annual assessments;
and
WHEREAS, on August 15, 1979, the Association Board
' of Directors voted to formally incorporate the amendment into
the By -Laws; and

WHEREAS, on October 17, 1979, the Board of
Directors of The Bluffs Homeowners' Community Association
voted to approve the modification of the By -Laws and to
change the Minutes of the Board of Directors to reflect
the revision of the By -Laws; and
WHEREAS, it is.necessary that the City,Council
of the City of Newport Beach consent to a revision of the
Declaration of Covenants, Conditions and Restrictions;
and
WHEREAS, by a letter dated January 23, 1980, the
president of the Association Board of Directors requested
that the City Council consent to the revision of the Decla-
ration of Covenants, Conditions and Restrictions for The
Bluffs.Homeowners' Community Association; and
WHEREAS, the City Council finds and determines
that said amendment to the Declaration of Covenants, Condi-
tions and Restrictions is fair and reasonable and in the
interest of the City and Bluffs Homeowners' Community Asso-
ciation,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that it hereby consents to the
proposed change to the Declaration of Covenants, Conditions
and Restrictions on Tract No. 5463 and Tract No. 5480 of The
Bluffs Homeowners'. Community Association.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized and directed to execute all documents
necessary to further the amendment to the Declaration of
Covenants, Conditions and Restrictions of The Bluffs Homeowners'
