RESOLUTION NO. 9916
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ORDERING THE VACATION AND
ABANDONMENT OF THE ALLEY LYING WESTERLY OF
107 -33RD STREET
WHEREAS, the Public Works Director of the City of
Newport Beach presented to the City Council of the City of
Newport Beach on October 14, 1980, a certain map prepared by the
Public Works Department dated September 26, 1980, and entitled
"Vacation of Alley Between Seashore Dr. & Ocean Front & Between
33rd St. & 34th St," drawing No. R /W- 5431 -L, which the City is
considering vacating; and
WHEREAS, the City Council of the City of Newport Beach
approved and adopted said map on October 14, 1980, and directed
the City Clerk to file same in the proceedings for the abandon-
ment of said alley lying westerly of 107 -33rd Street;
WHEREAS, on November 10, 1980, the City Council held a
public hearing for the purpose of hearing all persons interested
in or objecting to the,proposed vacation and abandonment of said
above - described alley; and
WHEREAS, the City Council finds and determines from all
of the'evidence submitted that the subject alley lying westerly
of 107 -33rd Street described herein and more particularly in
Resolution No. 9891 is unncessary for present or prospective
ispublic use,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the alley lying westerly of 107-
33rd Street, more particularly described as follows is hereby

ordered vacated and abandoned:
"That certain alley 10.00 feet in width
together with the corner cutoffs, having a
radius of 10.00 feet lying between Lots 9 and
® 27 in Block 33 of Newport Beach Tract as per
map recorded in Book 3, Page 26, of Miscella-
neous Maps, Records of Orange County, State of
California, excepting and reserving therefrom
a permanent ten -foot public utility easement
and right at any time, or from time to time,
to construct, maintain, operate, replace,
remove and renew sanitary sewers, water lines
and appurtenant structures in, upon, over and
across said alley proposed to be vacated and
pursuant to any existing franchises or renew-
als thereof, or otherwise, to construct, main-
tain, operate, replace, remove, renew and
enlarge lines of pipe, conduits, cables,
wires, poles, and other convenience struc-
tures, equipment and fixtures for the opera-
tion of telegraphic and telephone lines, and
for the transportation or distribution of
electric energy. There shall also be
reserved, for the benefit of the property
owners of Lots 1 through 9 and 27 in Block 33
of Newport Beach Tract mutual cross easements
for ingress and egress."
BE IT FURTHER RESOLVED that the City Clerk is hereby
ordered to cause a certified copy of such order attested by the
Clerk under the seal of the City of Newport Beach to be recorded
in the Office of the County Recorder of the County of Orange.
