• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPLYING TO THE LOCAL AGENCY
FORMATION COMMISSION (LAFCO) OF ORANGE COUNTY
FOR AUTHORIZATION TO ANNEX TO THE CITY OF
NEWPORT BEACH CERTAIN UNINHABITED TERRITORY
CONTIGUOUS TO THE CITY OF NEWPORT BEACH AND
KNOWN AS "THE OXBOW" (Annexation No. 88)
WHEREAS, certain parcels of real property, commonly
referred to as "The Oxbow" (hereinafter referred to as "the
property "), and more particularly described as:
That portion of Lot D of the Banning Tract,
together with that portion of the land shown
on a map filed, and annexed to the complaint
in Case No. 22797 of the Superior Court of
Orange County, California, all as shown on a
map filed in Book 65, Pages 31 through 36 of
Records of Surveys in the Office of the County
Recorder of said County, described as follows:
Parcel A
Beginning at a point in that certain course in
the existing Newport Beach City Boundary per
the Incorporation shown as "South 4 °31'33"
East 439.65 feet" on said record of survey map
distant thereon South 4 "31 "33" East 100.59
feet from the northwesterly terminus thereof,
said point being distant South 5 °26'08" West
423.20 feet, more or less, from the one -
quarter section corner common to Sections 20
and 29, T6S, R10W; thence along said boundary
as created by the Incorporation and by the
"Five Parcel" annexation through the following
courses: South 4 031133" East 339.06 feet;
thence South 20 011142" East: 269.65 feet to a
point on a non - tangent curve in the northerly
line of West Coast Highway concave northerly
and having a radius of 950.00 feet, a radial
line from said point bears North 6 058130"
East; thence easterly along said curve 4.35
feet through a central angel of 0 015145 ";
thence tangent from said curve South 83 017115"
• East 285.05 feet; thence leaving said city
boundary North 12 059157" West 200.50 feet;
thence South 77 000'03" West 60.00 feet; thence
North 12 059157" West 500.00 feet; thence South
77 000103" West 196.26 feet to the POINT OF
BEGINNING
Parcel B
Beginning at a point in that certain course in
• the existing Newport Beach City Boundary per
the Incorporation shown as "South 68 °22145"
East 756.00 feet" on said record of survey map
distant thereon South 68 022145" East 280.00
feet from the northwesterly terminus thereof,
said point being distant North 68 024'46" West
2457.17 feet, more or less;, from the one-
quarter section corner common to Sections 20
and 29, T6S, R10W; thence along said city
boundary South 68 022145" East 300.00 feet;
thence leaving said city boundary North
21 °37'15" East 250.00 feet.; thence North
68 °22'45" West 300.00 feet; thence South
21 037'15" West 250.00 feet to the POINT OF
BEGINNING,
are contiguous to the City of Newport Beach as shown on the map
attached to this resolution (Exhibit "A); and
WHEREAS, the City of Newport Beach is desirous of /
annexing the property for the following reasons:
A. The City of Newport Beach will soon have the right to
extract oil from wells currently located on the property and to
product, store, treat and transport oil in facilities to be
located on the property; and
B. It is the desire of the City of Newport Beach to
itself conduct the oil production and storage activity such that
the residents of the City of Newport; Beach will obtain maximum
benefits and revenues fro the subsurface rights attendant to the
property; and
C. Annexation of the property will facilitate the oil
• production activities of the City of Newport Beach and thereby
ensure maximum benefit to its citizens; and
D. The property is uninhabited, undeveloped except for
oil production facilities, will be used only in conjunction with

City of Newport Beach oil production activities for the
foreseeable future, and annexation by the City of Newport Beach
will thus be consistent with its exclusive use of the property;
and
WHEREAS, the City of Newport Beach, pursuant to the
provisions of the Municipal Reorganization Act (Section 35000 et
seq. of the Government Code), wishes to initiate proceedings for
the annexation of the property,
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach hereby requests that LAFCO initiate,
pursuant to the provisions of the municipal Reorganization Act,
preliminary proceedings for the annexation of The Oxbow (Annexa-
tion No. 88) and that LAFCO take whatever action is necessary to
implement this change of organization of the City of Newport
Beach.
