RESOLUTION NO. 9 941
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ORDERING THE VACATION AND
ABANDONMENT OF A PUBLIC UTILITY EASEMENT LYING
NORTHERLY OF EL CAPITAN DRIVE AND ALONG THE
SOUTHERLY BOUNDARY OF TRACT 9860
WHEREAS, the Public Works Director of the City of
Newport Beach presented to the City Council of the City of
Newport Beach on November 24, 1980, a certain map prepared by the
Public Works Department dated May 1, 1980, and entitled "Easement
Abandonment," drawing No. R /W- 5424 -L, which the City is
considering vacating; and
WHEREAS, the City Council of the City of Newport Beach
approved and adopted said map on November 24, 1980, and directed
the City Clerk to file same in the proceedings for the abandon-
ment of said public utility easement; and
WHEREAS, on December 22, 1980, the City Council held a
public hearing for the purpose of hearing all persons interested
in or objecting to the proposed vacation and abandonment of said
above - described public utility easement; and
WHEREAS, the City Council finds and determines from all
of the evidence submitted that the subject public utility
easement described herein and more particularly in Resolution No.
9924 is unncessary for present or prospective public use,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the public utility easement, more
particularly described as follows is hereby ordered vacated and
abandoned:
"That certain public utility easement, 16.00
feet wide, as shown on a map of Tract No. 9860
recorded in Book 435, pages 43, 44 and 45 of
Miscellaneous Maps in the Office of the County
Recorder of Orange County, California, lying
within the southerly 16.00 feet of Lots 8, 23,
24, 37 and 38 of said tract.
"Excepting therefrom those portions of said
Lot 24 lying within the westerly 15.00 feet of
said lot and the southerly 3.00 feet of the
westerly 35.00 feet of said lot."
BE IT FURTHER RESOLVED that the City Clerk is hereby
ordered to cause a certified copy of such order attested by the
Clerk under the seal of the City of Newport Beach to be recorded
in the Office of the County Recorder of the County of Orange.
