RESOLUTION NO.9945
• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING THE CITY'S INTENT
TO PROHIBIT THE CONSTRUCTION OF PERMANENT
BUILDINGS AND STRUCTURES WITHIN THE PROPOSED
RIGHT -OF -WAY FOR THE SANTA ANA RIVER FEDERAL
FLOOD CONTROL PROJECT
WHEREAS, the United States Corps of Engineers has
received authorization to proceed with the Santa Ana River Flood
Control project which will require the construction of channel
improvements in the lower Santa Ana River; and
WHEREAS, certain channel improvements will require
acquisition of certain property owned by, or within the corporate
limits of, the City of Newport Beach; and
WHEREAS, the County of Orange, the agency designated to
acquire right -of -way for this project, is entitled to reimburse-
ment under the State Subvention Program, only if in compliance
with the provisions of the Cobey - Alquist Flood Plain Management
A
Act; and
WHEREAS, compliance with the Cobey- Alquist Act would
ordinarily require that the City of Newport Beach adopt flood
plain regulations restricting development of the area to be
acquired, such that the costs of acquisition and subsequent
• reimbursement do not reflect expenditures for buildings or
structures built subsequent to the adoption of those regulations;
• and
WHEREAS, the property located within the project
boundaries which is owned by, or within the corporate limits of,
the City of Newport Beach will not be developed because it is

• owned by the City of Newport Beach or a public agency involved in
this project and /or such property is of such a size and configu-
ration that it cannot accommodate buildings or structures; and
WHEREAS, the adoption of flood plain regulations cover-
ing property within project boundaries is unncessary given the
undevelopable nature of that property,
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach hereby declares its intention to
prohibit the development of any and all property within the
boundaries of the Santa Ana River Flood Control project which is
owned by, or within the corporate limits of, the City of Newport
Beach.
BE IT FURTHER RESOLVED that the Building Director is
hereby ordered not to issue any permit which would allow the
construction of any building or structure on any property located
within the boundaries of the Santa Ana River Flood Control
project, which property is owned by, or located within the
corporate limits of, the City of Newport Beach.
