A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING A CONSENT AND
AGREEMENT BETWEEN BEEK ET AL., AND THE CITY OF
NEWPORT REGARDING THE ASSIGNMENT OF THE BALBOA
YACHT BASIN LEASE
WHEREAS, Barton Beek, Allan Beek and Seymour Beek, as
Executors of the Will of Carroll B. Beek, deceased, and Barton
Beek, Joseph Allan Beek, Jr., and Seymour Beek, in their
individual capacities, successors to Lessees, J. A. Beek, Carroll
B. Beek, Barton Beek and Joseph Allan Beek, Jr., hereinafter
"Beek ", have presented a Consent and Agreement, consenting to the
assignment of the Balboa Yacht Basin Lease from The Irvine
Company, a Michigan Corporation, to The City of Newport Beach;
and
WHEREAS, the City Council has reviewed the terms and
conditions of said Consent and Agreement and found them to be
fair, just and equitable, and agree to the terms and conditions
contained therein,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the Consent and Agreement between
Beek et al., and the City of Newport Beach regarding the
Assignment of the Balboa Yacht Basin Lease be and it is hereby
approved. The Mayor and City Clerk are hereby authorized and
directed to execute said Consent and Agreement on behalf of the
City of Newport Beach.
