• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH SUMMARILY VACATING AND
ABANDONING A STORM DRAIN EASEMENT OVER A
PORTION OF BLOCK 0 -33 CORONA DEL MAR TRACT
WHEREAS, on or about March 11, 1959, Jay Herbert
Brownell and Phoebe Lu Brownell dedicated to the City of Newport
Beach an easement for storm drain purposes, over a portion of
Block 0 -33, Corona Del Mar tract, which easement is more
particularly described in that Grant Deed of Easement, a copy of
which is attached to this Resolution as Exhibit "A", and
incorporated herein by reference as though fully set forth at
length;
WHEREAS, for more than five years immediately
preceeding the date of this Resolution the easement described
above has remained continuously unused by the City of Newport
Beach for any public purpose; and
WHEREAS, there are no public utility facilities in
place that would be affected by the vacation of this easement;
and
WHEREAS, no money has beeia expended during the five
year period immediately preceeding the date of this Resolution
for the maintenance of the easement; and
WHEREAS, the easement is unnecessary for present or
perspective public use and it is the desire of the City of
Newport Beach to summarily vacate this easement pursuant to the
provisions of Chapter 4, Part 3, Division 9 of the Streets and
• Highways Code of the State of California (Sections 8330 through
8336 Streets and Highways Code).
NOW, THEREFORE be it resolved by the City Council of
the City of Newport Beach that the easement described in Exhibit
"A" be summarily vacated and abandoned; and
BE IT FURTHER RESOLVED that the City Clerk shall cause
a certified copy of this Resolution, attested by the City Clerk
• under seal, to be recorded in the office of the Recorder of the
County of Orange; and
BE IT FURTHER RESOLVED that from and after the date
this Resolution is rcorded, the access easement depicted and
legally described in Exhibit "A" shall no longer constitute an
access easement.
